Pleast: Seller charging 2-day Fedex but has no intention to abide by his stated shipping practices

Seller has 2-day Fedex option in shipping choices.

It's Friday evening and I purchase product with 2-day Fedex option.

 

On Saturday, I communicate with seller who states they are going to use USPS and 'it's faster'.

I respond that I only purchased this product because of the 2-day Fedex. Fedex is open on Saturday and 2-day would be Monday delivery.

 

Seller back and forth and then states: "OK, I will mail it Fedex on Monday."

I tried to cancel this transaction twice but seller marked shipped with tracking and that blocked cancellation.

Package sat for 3 days and mailed. It's now been 5 days. Seller ignored completely requests to cancel.

Instead, condescending pejorative remarks that I should "not worry." 

 

I've filed a case with Ebay. Seller has loads of negative comments to which he bullies buyers.

 

Question for community:

 

What is your advice? Has this happened to you? How did you manage this?

FedEx Two Day shipping does not include the weekends. I've shipped packages for FedEx and UPS on Saturday and while the stores are open to give them an acceptance scan, they do not actually move until Monday. So the seller was partially right in that he could potentially mail something on Saturday via USPS, before their cutoff time ,and depending on destination it could arrive on Monday. But it sounds like he drug his heels and didn't ship until the next Monday and used USPS anyway. The seller is not supposed to downgrade shipping and some believe that constitutes a reason to file for a return using "not described" as the basis.  At any rate, you can leave feedback expressing your displeasure with the slowness of shipping and the change in shipping methods. You cannot file for a cancellation while the package is enroute. Just wait until arrival and then make your next move.

Thank you, yes.  He charged for Fedex but was opting to wait until Monday then go USPS. Importantly I paid for 2-day Fedex.  He opted to keep my Fedex shipping fee then ship at his convenience and USPS. 

He ignored my request for information. I go by sellers' listings information. I did not sign up for a debate to follow after I paid for a certain shipping option. I dislike giving negative reviews. I prefer to deal with transparent sellers.  He has several negative reviews already.

With FedEx 2 day shipping, your packages are delivered within 2 business days ( this is direct from the FedEx page)

Saturday and Sunday are not counted a business days....so that mean seller was fine to ship on Monday by FedEx.

What kind of case did you open? If you opened an INR case then once the seller shows delivery they win the case and feedback is blocked or removed if you have already left it.

The seller is wrong for not sending it Fedex 2 day however keep in mind the seller may also has a handling time as well. For instance mine is 2 business days to get the item out so if you ordered an item Friday at noon and I have Fedex 2 day shipping I will not ship it out until Monday however technically I don't have to get it out until Tuesday. Unless the seller ships in 1 business day seller aren't obligated to ship on the weekends.

Thanks for taking the time to provide your opinion. Unfortunately sellers with negative feedback who already have issues with communication transparency are setting themselves up to fail. Thanks again.

Friday evening purchase would be shipped on Monday regardless of the shipping service selected if the seller has "1 day handling". Ship date would be later if 2 day, 3 day, or more "handling time"  

 

But  you are correct, the seller should not downgrade the level of service paid for.

Again, whether they're open on Saturday or not, seller isn't required to ship that day. However the seller cannot ship by USPS if you chose the Fedex option.

Although most experienced seller will agree to cancellation requests, they aren't required to cancel. You don't seem to understand "business days."

 

I'm curious to see the listing and know what shows as the seller's handling time because it's very possible that YOU didn't read carefully enough to understand the seller's terms.

Wouldn't it have been a good idea to read the seller's feedback BEFORE buying from him?

My advice would be to wait for the item to arrive, see what shipping carrier the seller chose, see if the item arrived before the estimated delivery date as shown on the order and take it from there.

 

How I've managed similar situations is to wait it out and if the item is as described, accept it and be happy. If the seller shipped by a different (cheaper) method than the listing promised, I would let the seller know that it isn't allowed. Unless the seller's response was egregious, I wouldn't leave feedback and I'd make a note not to buy from that seller again.
