Package damaged due to seller negligence

So, my mom bought a very expensive, brand new lego set that was sealed in the box. When she received the item, she found the seller did not put the set in a box for shipping & had put the shipping labels directly on the lego box & put packaging tape on all of the seams of the box as well. The box alone for the set cost $150 at the moment.

 Also the back of the box was so damaged there was a big tear in the box. When she checked to see if everything was there, she found one of the bags had an opening in it & a piece could have been lost. She contacted the seller & he said she would need to file a claim with USPS. Would she need to file a claim with ebay since the item did not show up as shown in the pictures on the listing due to the seller not packaging the item correctly ?

The seller is wrong,  shipping insurance is to protect the seller not the buyer. The seller is responsible for getting the item safely to the buyer.

 

She needs to open a not as described case on e-bay.  The seller will have to send you a return label if they want it back and they will have to refund once tracking shows delivery to them, otherwise they will have to refund and you keep the damaged item.

 

DO NOT let the seller convince you to close the request, you can not re-open it.

I work for USPS. The seller is wrong.

 

The shelf display boxes are never meant to ship as shipping boxes. Insurance if it even had it would be denied  due to poor packing.

 

With items New In Packaging, the box is part of the items value, them even attaching the label to it damaged that value.

You are completely in the right and this seller is completely in the wrong. It is vital that you open a case for item not as described right away. Make sure you chose that option as you only have one time to open a case. Your item is guaranteed money back by eBay so you will receive a full refund for it.

 

This is a bad seller who should know better than to use the original box and not have placed this expensive item into a shipping box. What a ridiculously poor choice they made. They must be a new seller to have done something so idiotic. They may as well have shipped you a ring in a ring box with a label glued onto it.....SMH

 

Just make sure you chose the correct reason for opening your case, that's very important for you in order to receive your refund. Read up on how to do a return. Best of luck to you....

I don't know why some sellers do this because many manufacturer's cardboard boxes are thin walled and were not intended as shipping containers.  Moreover, buyers like these boxes intact so they can be given as gifts. Even if my item is packaged well enough to be used for shipping I still cover it up  with thick poly vinyl wrapping so that no one knows what it contains. 

 

In any event open a claim for not as described as the seller needs to provide you with a return shipping label.  The buyer is not responsible for filing a USPS damage claim as it was insured by the seller and the reimbursement if any goes to them.  The seller may ask you for pictures so they can file the damage claim but they still have to refund the buyer regardless of whether they want the item returned.  Also when the claim is filed  I would upload pictures and mention any defects such as one of the bags opened with possible missing pieces.

Insurance is for the seller.

Buyers are covered by the eBay MBG.

 

When something is damaged in shipping, the seller refunds the buyer ... and the seller files the insurance claim.

 

Go to your Purchase History

Select "Return this Item" from the dropdown menu (if there is no big blue button).

Select "Arrived Damaged"

The seller will have 3 business days to accept the return, or refund you in full (their choice).

When they accept the return, you will be issued a pre-paid return label.

 

*** On International returns, eBay cannot automatically issue a return label. The seller is obligated to manually send a label or send funds for a label (upfront, not after). ***

 

If they do not, then you can ask ebay to step in on the 4th business day after opening the return.

You will have 5 business days to get the item into the mail. Make sure to get an acceptance scan.

When the return is Delivered back to the seller, they will have 2 business days to refund you.

If they do not, you can ask eBay to step in to force the refund.
