I been contacting the seller letting them know that they need to contact fedex cause they lost my package no reply from seller I contacted fedex today and they open a case and for seller to reply to them so I can get my refund

You have eBays Money Back Guarantee. Why don't you use it and file for a Item not recieved case to get your refund? Fedex isn't going to do that.

Simply open a 'return' for 'not received' if it is at least 1 day past the last estimated delivery date.
Not delivered is a seller problem as well as getting any 'insurance' payment for it. Sellers are just to refund the buyer.

One day past the last given delivery date you can file an item not received. I would allow some extra time for shipping delays but, your NOT required to. Once the time has passed, you can click the I have not received the item button and file a case.
As for contacting the shipper, that is the seller's problem. Your refund is not dependent on their insurance recovery.

Others are correct that you need to open a Item Not Received case via eBay. That will get you a refund from the seller. Before you get too upset about the seller not responding to you already - remember it was a holiday week and not all eBay sellers are as diligent as others about responding to eBay messages during holidays or if they have family in town. Hopefully your seller will get in contact with you today.
Fedex, at best, would issue a refund to the seller for any insurance that the seller paid for.
What might happen is that opening a lost package claim with Fedex may shake the package loose. It happens quite a bit for me with USPS if I open a missing mail request.
