Item not arrived/Damage item

I bought  a phone on Dec 14, and the delivery date says that the phone will be  arriving on by Dec 21. It is already Dec 24, and the item just departed from the origin country. I got that information through the tracking number. The seller started the delivery process 4 days after I placed the order.

 

So, I am really unhappy that the item cannot arrive before Christmas. It is supposed to be a Christmas gift. What purpose do the item have when it can't be given to other people during Christmas?

 

Another thing that concern me is that, the seller is using such a long delivery method. What if the item arrived broken/damaged, due to the impacts during the shipment? What should I do? Do I still need to pay the shipment fees to return the damaged item to the seller?

 

What if the item becomes damaged, after using it for either one day or one week or one month, due to the choice of seller using such a long shipment method, which causes a lot of impacts during the shipment? Who is going to be responsible for this?

 

*There is only one shipping choice provided by the seller.

If you needed the item before Christmas, and you ordered from overseas, you should have allowed at LEAST 4 weeks for delivery

You could use it your self.  You could give it to the intended person a few days late.  You could sell it.

Well delivery dates are not guaranteed, they are estimates and quite frankly, at this time of year you should expect delays due to the holidays. Placing an international order 10 days before you need the phone was not a smart move.

The seller put on the page that the item can be delivered to me in one week. I took the information he put on the page into consideration when I was deciding if I wanted to buy the item. It is a different case if the seller put that it needs at least 4 weeks to be delivered. I put my trust in the information that the seller posted. How am I supposed to know how long the item should take to be delivered? I am not the one who shipped the item.

 

It is the responsibility for the seller to put correct information on the page. If the item needs 4 weeks to be delivered, the seller should have stated that the items need 4 weeks to be delivered on the page. It is a unethical to put wrong information on the page to deceive the customers to buy the item.

I wouldn't order anything from ebay 6 business days before Christmas. Never, ever. In fact, I don't order anything, no matter where it's coming from, that soon.

 

If the item is past it's last estimated delivery date, you can open an item not received case. And if it arrives broken or damaged, you can then open an item not as described within 30 days of the actual delivery date.

If the seller knows that the item can't arrive by the estimated delivery date due to holiday, the seller should extends the estimated delivery date for holiday period. The seller is supposed to change the estimated delivery date from time to time, according to the time of the year.

 

He should let the customer know that the shipping would be longer than usual, before the customer decides to buy the item and pay for it. Then, that is acceptable.

 

However, the seller did not tell me that the shipping would be longer before the payment goes through. And, this is unacceptable.

No, the seller didn't do that.  The system did and everbody here has been complaining about those inaccurate dates.

 

There is no blame here on the seller.  As others have said, orders placed after the first of December are simply a gamble on whether or not they will arrive soon enough to be used as gifts.  People simply need to plan further ahead and order earlier.

While certainly annoying, this is one of those cases where common sense should kick in. A week before Christmas and you order from a foreign country? No, I would never do that and you shouldn't either.

 

On Dec. 22 you should have opened a case for item not received. It would not help you get the phone but it would get you your money back.  Take some time to read the Money Back Guarantee. The link is posted on just about every eBay page. You should also look at the seller's feedback (READ the negatives) the item location and the estimated delivery date.

No, it isn't necessary for you to return it.  You could use it as stated above.  If you CHOOSE to return it, then you will be responsible for shipping costs.

As others have said, it is NOT the seller who puts those estimated delivery dates in the listing. So you can't blame him for that.

I've been freaking out about that blurb saying delivery before Christmas on my listings for the past 10 days. eBay puts it there, not your seller.

 

Lucky for me, when I checked yesterday, EVERYTHING had been delivered. For the last few orders I have had in my listings that the item WILL NOT arrive before Christmas. I'm sure I lost a sale or 2, but losing a difficult sale is something I am willing to accept.

To add to the other responses, you could have requested that the seller ship via Express (or EMS, if it was an international seller) and paid for the faster shipping method.  And as stated, the Seller does not enter the "delivery date," and yes, those dates are "estimate dates" and not guaranteed dates.  Even with Express/EMS mail, there can be a delay in delivery.

The estimated dates on the listings are Ebay's doings, the seller does not put the dates on there.

The dates are just an estimate, there is no way to guarantee the item will arrive by that date.

Since the item is being shipped from another country, it's probably taking longer to get through customs this time of year and the seller has nothing to do with the delay from customs.
