I'm So Conflicted...Any Advice?

Hi All,

*8/22: buyer messaged me complaining she was very displeased with a dress I sold. She said it was listed as NWT but the dress she received was used.

 

*8/22: as I was reponding to her message explaining the listing clearly stated Pre-Owned & to return for refund, she opened a SNAD saying the dress was supposed to be NWT, but wasn't, and it was wrinkled and smelled.

 

* 8/22: I called ebay and they could see from the messages that she didn't read the listing. They told me to accept the return and they would refund me the cost of the shipping label. So I did.

 

* The buyer was given until 8/29 to return the item.

 

* 8/30: This morning I called ebay as the deadline had passed and the case was closed in my favor.

 

*8/30: Right after the case was closed, I received the following message from the buyer:

Hi eBay, (this was sent to my in-box as "buyer has a question...)
I have already sent the dress back by US mail.
I can't understand how I have to wait longer for an item I purchased
and have less time to return an item that I was not pleased with. (she received her item in 4 days but had 7 to send it back!)
My problem with the dress was not that I thought the dress was new.(yes it was,that was her first 2 lines of reasoning for the SNAD)
My problem was the condition of the item your seller sold me.
I think the policy is unfair.
Very displeased with the decision not to refund my money.

 

*8/30: Buyer left me negative feedback which ebay promptly removed before I could even read it.

 

I have blocked her as of today. However, I really believe she thought she was getting a NWT item. I'd be happy to refund her just the cost of the dress, not shipping charges, if I do get it back. Is that even possible? Or should I just leave it alone?

I wouldn't give that buyer back one penny if I didn't have to.

Buyer may have been confused by your disclaimer in the listing:

 

New With Tags (NWT) items will NOT be accepted for return if the garment has been worn or damaged, or the tags have been removed!

 

I'd refund the $14.72 at least through paypal.  I'm not sure whether or not this might trigger a cancellation defect on eBay.  I would also remove that line from future listings, starting with those that are not NWT.

Good point! I never even thought that could be confusing. Really appreciate you pointing it out! How would refunding through paypal trigger a cancellation defect? Thanks!

Why would you refund this buyer?  The listing looks crystal clear to me. 

 

This buyer had zero problem putting the screws to you money-wise even when it was obviously their fault.  And when that didn't work, they left you a neg?    I vote no refund. Smiley Happy

 

BTW, how do you know they left you a neg if you didnt see it?  Just curious.

Refund her money as soon as you get the item back.  It is the right thing to do.

I guess if I do get the dress back, I just feel a refund is the right thing to do.

As for the negative feedback, I went under Orders, Paid & Shipped, and to the far right in the Feedback column there is a red negative circle meaning she left a negative at some point .

Good point! I never even thought that could be confusing.

 

Especially if buyer was searching for "NWT dress".  It also appears to conflict with eBay's current wording of the Condition of Items Returned policy.  eBay no longer allows sellers to define return conditions them in the listing; they can only choose from what's in eBay's dropdowns.

 

How would refunding through paypal trigger a cancellation defect?

 

Some sellers have noticed an Out Of Stock / Cancellation defect when they refunded the majoity of a payment.  It of course should NOT apply to your situation, but eBay doesn't always train its bots very well.

If the dress comes back I would refund minus the shipping fee and selling fees you incurred. As for your listings, they look fine to me. Was labeled twice I seen as "pre-owned" so had she read the description she would of surely seen it. I don't make separate policies for different listings but to remove any confusion for those who fail to read I would remove the NWT's part and just state that any items worn, used, stained or altered will only receive a partial or that returns won't be accepted. That should include removing tags as they couldn't possibly send it back in the same new condition as they'd received it. Good thing Ebay defended you, that rarely happens!

It is my understanding that a refund through paypal would only trigger an out of stock defect if the item does not have tracking showing delivered.

UPDATE:

So, I was checking my account summary tonight and I found this:

 

283065059818    Aug-30-18 07:21:59 PDT     Return Shipping Fee     US $3.50  

 

Apparently she did send the dress back, but AFTER the case was closed.

I'm just so frustrated at this point.

If you get the dress back after all, a partial refund (sans shipping fees) would be the most honest course of action IMO. But you're not technically required to refund the item at this point since eBay has already ruled in your favor.

OP, this buyer has wasted your time which is worth something, they tried to waste your money and they tried to damage your reputation.  T hey didn't read your listing and they didn't follow the rules of the return process.

 

There is no way I would refund this buyer.    They need to learn a lesson.

Yeah, they need to learn to fund with credit card.  Otherwise, eBay will convert a "60 Day Return Policy" into "5 days and 1 second".
