Hello all,
I am in return process as a buyer with an order.
The request for return it was accepted, but the first message from eBay system it was :
The seller can't send a return postage label.
I requested via messaging system to create a shipping label because the seller is responsible with shipping return process. I am doing right ? What is next step ?
I'm from Europe and seller is from USA. I'am afraid that if I send using my shipping method the buyer will refuse to pay the transport. I already lose some money with faulty item, if I pay the return exist the possibility to lose more too. How can I avoid this ?

Regardless of where you are located the seller is responsible for the return shipping of a not as described item if you file the SNAD dispute. If I'm not mistaken, they would have to send you the money to cover the return shipping if they cannot send a shipping label.
However, I'm a bit confused as to what shipping method you intend to use and why the seller would balk at paying for that method. You should use an extravagant method when a less expensive one would suffice. Provided that it has tracking, of course. You should discuss it with the seller prior to the return and he should send you the funds to cover the return shipping before you send it back. Of course, you will have to wait until the item is delivered back to the seller before you receive your refund for the item and original shipping.

From seller to me postage it was 70$ + duties ( at custom payed by me ).
From me to seller I think will be same amount , maximum 100$ possible at checkout , I made only a simulation (TNT, FedEx, DHL).
I requested to create a shipping order from our local sites, seller claimed that can't create a shipping order because cannot put the his signature for custom info.
If seller give the accord in message for me (buyer) to create the shipping order with the promise of payment at the end, how can I obtain the shipping charges for returning product ?
But if at arrival he refuse to sing for reception ? Or even worse, if seller put the info for mailing at wrong address (by the way his address is without name ) ?

The seller is responsible for the return shipping, but they are correct that they can't provide a prepaid label because they are not in your country. So you need to find out exactly what the return shipping will cost, and let them know. They are supposed to send you the exact amount of money by PayPal. They should send the money upfront, before you send the item back. If you don't get the money upfront, then eBay can't force the seller to refund you for the return shipping.
You should use the Post Office to send it back, as long as the Romanian Post Office has a service that will provide tracking with delivery confirmation. Don't use Registered Mail, it often doesn't get a delivery scan in the USA. What you need is a tracking number that can be viewed online, which will show a delivery confirmation after it is delivered. You will need to fill out customs forms, and you should clearly state "Defective merchandise being returned" after the description of what the item is.
You should not use a private courier, because they charge extra brokerage fees to take the item through customs.
You need to send it to the return address that you get from eBay in the case in the Resolution Center.
It doesn't matter if the seller signs for it or not. You need to use Signature Required only if the item is more than $750, otherwise don't use it. As long as there is a Delivered, Attempted Delivery or Out for Delivery scan, that will be all you need.

Can 't you use the seller's name shown on your PayPal payment? Remember, don't send the item back with online-viewable tracking until after you receive sufficient CASH in your PayPal account.
BTW eBay left off the name, not the seller.

In order to get any duties that you paid to your country you will, I believe, have to look to your country's customs to get those refunded.

But if I don't sent the item back is risk to trigger this clause :"we might close your return and there's a chance you won't get a refund". So I'am forced to proceed for seeding item. Is true this ?

Alas! I'm having a bit of trouble understanding you. If I get what you are asking correctly, yes you would be in danger of having the case closed if you failed to return the item within the time period specified by eBay's resolution center so you will need to send the item back.
Customs duties are something between you and your government. I believe that most governments have a way to apply for a refund of duty paid when the merchandise is returned but I'm not sure about how to go about applying for it. You will need to check with your customs office for the particulars of that.

You committed a grave error @wolfydrg and it's likely you you won't get your 3$0 back: You needed the return shipping in cash, before your bought the return label. Did you get your customs duty refunded?

For these 30$ maybe I will resolve with ebay support team. Maybe, if not 😞
