How to Appeal

So my situation is as follows:

- Purcahsed a laptop battery on eBay

- Get the battery, DOA, confirmed to be battery, contact seller, they reply back within 12 hours, they send me a new one

- Second battery doesn't have the same issue as first, SEEMS to work, tell seller it seems to work, leave positive feedback

- Laptop starts shutting down randomly and requires to be plugged into adapter to turn on, battery still has 60% charge, read forums and update BIOS and do everything possible to the laptop to determine it is working properly, test exact same scenario with old battery to determine the the second new battery recieved from seller is also faulty

- Contact seller and ask for a refund, I will send back both faulty batteries (within 30 days of the second replacement battery)

- Seller doesnt reply

- Send seller another message via eBay and refund service and seller closes the request within a couple of hours

- I do not have an "Appeal" option for this item on my dashboard

- When I open up the transaction it shows the original and replacement batteries but I think I used a refund request on the first one which would be >30 days expired instead of the second one which would be <30 days but when I try again on the second battery it says it has already been used (because of the first)

I have proof of e-mails showing I asked for a refund within the 30 days of recieving the replacement battery. Can someone suggest what my course of actions should be?

Re: How to Appeal

I don't think you have an recourse through ebay, you have 30 days from the date you recieved the original battery to file a request. If the seller was able to close your request, it is because the money back guarantee had expired. The replacement was not covered by the MBG, only the first one was and the date you recieves that battery is when the clock starts. So there is nothing to appeal. You should always take a refund instead of a replacement. If you funded the PayPal payment with a credit card, try filing a chargeback.

Re: How to Appeal

So you're saying a seller could send me a DOA replacement which doesn't arrive until more than 30 days past the original DOA product and eBay is okay with that because it is more than 30 days past the original arrival of the first DOA product. Whereas this case is that the second faulty product was not proven to be faulty until more than 30 days after the original DOA product was recieved.

I don't know what a chargeback is so I will need to look into it, thanks for the suggestion.

Re: How to Appeal

the MBG is inflexible. If you open a case and recieve a replacement, ebay considers the problem resolved. It's a done deal. That's why you should always go with a refund. To file a chargeback, you just dispute the charge with your credit card issuer. You can call them or probably even log into your account online and do it. Good luck! I definitely wasn't advocating for the seller here. It's just that the money back guarantee is not flexible, it has a strict deadline and it does not allow you to go back and request a refund if the replacenent is DOA/SNAD.
