I purchased an item back in mid November for a Xmas gift which turned out to be a counterfeit item. We did not open the item until Dec 30th due to traveling. I immediately started the return ticket as soon as I discovered the item was a fake. Looking through how eBay handles these situations, they say I can have them step in and help out, but I do not see that option anywhere in the "Return Details" page. It's been more than 3 business days since I filed the original ticket and the seller has not responded (nor do I expect them to). The item was de-listed as soon as it was marked as shipped as well. What are my next steps so I can get my money back and return this item?

Did you also read @wingfan191 that a return request cannot be escalated if it was started beyond 30 days of actual deliverance?
Unfortunately, you'll have to complete the transaction outside of eBay now, either with a PayPal dispute http://paypal.com/disputes or a credit card chargeback; either way, you're responsible for return shipping with online-viewable tracking.

Seeing as how this was as gift and was not going to be opened for more than 30 days after purchase, I will probably contact eBay directly and see if there's anything they can do before I use the PayPal dispute method. Thanks for your suggestions.

YOU HAVE TO ASK THEM TO STEP IN, MAKE SURE YOU HAVE PROOF AND EMAILS

It is past the MBG deadline. There is nothing eBay can or will do. A call would be a waste of time. They will tell you to work it out with the seller.
Just go to PayPal and open the claim.

eBay's MBG says 30 days after delivery is just 30 days and nothing about an exception for a package that won't be opened after that.
Trust you have solid (as in verified in writing) proof that this item is a "fake".

I'm going through this right now... ordered in October for Christmas, didn't open the package until December, and immediately saw that half the contents ( Over $150 in DVDs) we're removed from the packaging and had very blurry inserts for the covers, plus the package they came in itself says they were made in China when the ad says it was all new in packaging and manufactured in the USA. The seller just keeps telling me that he rented a warehouse and hired people to run it, but the DVDs are real and he's going to sue them. All I want is to return the **bleep** DVDs and get my money back. I even said I would pay shipping. Instead all I'm getting is the runaround. I really feel like I'm banging my head against a wall and should have set the money I spent on fire instead. I'm so frustrated right now.

Ebay doesnt 'ban' people if they file a case thru PP, Ive done it twice myself.

Hi!
I'm actually going through the same thing as you with a counterfeit item that I bought around the end of October (I believe). Took 3 months to get to me, and I received it a few days before Christmas. Found out it was counterfeit, so I opened a case with eBay saying it was not authentic. eBay decided in my favor for this. Just post pictures of why you believe it's not authentic. Puts NOTES. I bought a Dyson Airwrap and it just had fake all over it. Right now, I am currently tracking the shipment to the seller but the seller hasn't picked the item up yet. I'm hoping once it's delivered, I'll get my refund back for sure. Just open up a case! Do it with eBay. If it's pass the window for returns, use PayPal. That's what I would do.
