So to make a long story short, we sell expensive items on ebay, about $3000.00 each, data processors. One buyer purchased 7 of them, he had 10 positive feedback, been on ebay for about a year, paid right away, messaged thanks ect.. so felt it was ok as we had "seller protection".
After receiving the items and signing for htem he opened a claim for item not received, i submitted all info to ebay, and they closed the case showing he did receive them.
Than he opens a claim for all of them are broken, and they are all wrong. Ebay unfortunitly forced us to send them return labels to get the items back. We had documented photos of the items we shipped, serial numbers, weights of packages ect..... we messaged him multiple times with no response to any messages at all.
Buyer shipped back 7 different items worth nothing, and ebay refunded him.
We asked about an appeal, and said we cant appeal it, and also said seller protection does not cover us as we are a "business" and we should account for stuff like this.
I mean, is this really the norm? Where am i supposed to go from here. Coincidentally we see our similar items with serial numbers blocked out for sale now 5 miles from his zip code. This is crazy.

I'm curious about what suggestions were in the links to help prevent this from happening in the future. Seems like you've went above and beyond to provide evidence that should've prevented it from happening this time. I can't think of any other suggestion they could give other than local pick up with a wire transfer directly into your bank account for payment. Maybe they would suggest not to sell anything on ebay in order to avoid these problems in the future.
To answer your question at the end....an honest buyer.
It sounds like you've got plenty of evidence for investigators to work with, so seek prosecution to the fullest extent of the law.
Oh and one other thing...
" we as a business sould expect losses may occur"
I believe a piece of their own advice is what a comment like that would deserve. Tell them that as a business, they should soak it up.

You mentioned that the serial numbers are blocked out. Do you have the serial numbers?
Once those numbers are reported stolen, the police can confiscate them.

I had the same thing happen to me and got screwed by eBay. $300.00
Shipped a set of Crain rocker arms to a guy and he sent back a set of junk one's.
A simular incident with one of our show car performance engines.
The guy crashed the car with the new engine in it.
Pulled engine back out of the crashed car and filed a claim.
Not only was the new engine now used but compleatly hammered from being in a wreck.
Without ever contacting us eBay refunded his money = $6,800.00 plus shipping from California to Alabama.
Pulling the money out of our bank account with no warning.
The engine showed up here and we took photos of the destroyed engine.
After seeing the engine we knew it came out of a crashed car.
Looked on the news for his town and sure enough photos of his crashed car with his name and date of the accident.
We sent all of the photos and information to eBay.
Their response was "sorry it is a closed case".
There was never a case opened.
We were never allowed to go through the promished mediation.
I suppose I should mention that the engine came back missing lots of parts too.
EBAY ripped us off.

Today we asked for a simple middle ground, credit to our seller fees for the amount of the loss. In that sense ebay is losing no money at all, and keeping a high volume seller satisfied. They just said no, sorry as a business you are expected to account for the loss ect....
Its frustrating, i would think with amazon around now ebay would be a little more supportive of sellers here.
we now went to BBB, facebook, and news. just have to keep waiting i guess.

that really sucks....
reading all the responses you have received, I would contact the carrier. since the thief claims the items arrived broken, file a insurance claim with the carrier. they may visit the thief.
if all else fails, hire a couple thugs to go visit the thief.

Sorry this has happen to you. File a police report, file a claim with the ICC, and I would be knocking on their door. As you see Ebay wont help, and I would be contacting a lawyer in the buyers town. This is totally unacceptable and I would have to think about notifying a local news station and everybody else I could think of!!!!!! Ebay should be found liable for this

If I were unethical, I'd scam them right back by buying the items from their auctions and then returning the junk they sent you. Or perhaps I'd have a friend to that so it wasn't obvious I was trying to scam my scammer. What's good for the goose and all that...

Just an update, ebay still refuses to assist in this case. Not only that, they are now also not refunding our ebay fees on the sale. That is pretty much a slap in the face. It is frustrating this is the way this marketplace is now, but i guess this is also the reason for the growth on amazon in this region. As much as people complain about amazon this would not happen on there, they actually review information and do back the seller.

Wow. I no longer seller here so no, I haven’t been contacted by a lawyer. This is the first I have heard of this on the boards. Many sellers have talked about a putting together a class action suit for this but it has been nothing but talk. Until now.
