Sold buyer new sealed item. My listing on this item says no returns accepted.

Immediately after sale buyer asks me if I have any more, which I said yes, and could do a discount on multiples. He said simply "thank you".

Next day after buyer receives, opens a return request that item was damaged. Also said he doesn't want a replacement because it would take too long to get, can he just get a refund. And hounds me about it.

Sent some clear photos of damage. Inside the item. Not outside. 

 

So he complied with my request for pictures outside, selectively, and they were blurry.

 

I called ebay for advice, rep said if I don't accept return I will be forced to accept it and money will be out of my account. So I accepted the return so I have a 2 day window to inspect.

 

Received item today. In the dark area of a photo it has sticky sticker residue, missing parts, and looks like it was well used. Definitely opened and used. When I received it is definitely sticky there, and There are patterned marks on the corners, like it was put in a vise or clamp over and over and tightened to make it look bent/ broken. I called USPS, have a case number, spoke to the manager at their local PO and the carrier supposedly doesn't remember anything special about the package being torn/broken/etc. PS the guy lives in a really nice house.

 

Called ebay rep today and asked should I escalate this claim as buyer not returned in same condition as sold, or should I do it online. Said I should do it over the phone since I'm on the phone with her. Non US rep.

Rep said that the buyer stated the item was damaged and damaged in transit so you should go through postal insurance to get your money back. I said that exactly what I wrote above, and she tried to twist my words into that it was damaged in transit blah blah blah. I hung up.

 

So I have seen and heard of sellers winning cases where the item comes back not in same condition, should I try the "ask ebay to step in and help" or do it over the phone with another rep, which would be more effective? I know I have a slim chance of winning, but entertain me for a few minutes reading this.

Sorry, you won't win, and will lose more if you escalate. Just refund the buyer.

If you ask eBay to step in, they will force the refund because, as far as they know, you got the item back.

 

If they force the refund, you also lose selling final value fees.

 

Unfortunately, there isn't much can do as far as eBay is concerned except issue the refund and report the buyer.

 

Part of my answer would depend on how far you want to take it (and how valuable the item is) so I'll leave it there until you say more.

I have a postal case open with the post office, and got the number for the local postal inspector. He has done this before to others.

 

Additionally, I found this doing a google search on I believe past boards, seems like sellers win--sometimes:

 

"We understand that you have returned your item because it wasn't as expected. We've issued you a refund for both the purchase price and the shipping costs. 

There was concern that this item was returned to the seller in a different condition than how it was shipped. As a courtesy for this case, you have been issued a full refund by eBay. For future returns please ensure that the item is returned in same condition as it was received."

So how can I win?
