Exhibit A. Buyer keeps requesting partial refund after repeat stating he won't be returning it.

1st email before he even purchased perfect condition Brazeli for $369.99 (1 day after original date of listing creation and 4 watchers):

 

04/09/18: approx measurements and,is that grease build up on the plates? or just the photo..
also are the plates removable? thanks david

 

My reply: 

Hello,
The plates are non removeable and that is just glare from flash of camera reflected on the already shiny non-stick iron plates. Appliance has been thoroughly cleaned for shipment. Take care.

 

04/09/18: thank you.was this your personal item? and is that the original plug? you wouldn't consider 300.00?

 

Moments after he sent his 2nd email before I even replied, he purchased the Brazeli (before I could block him because I block everybody who asks for a lower price).

Hello,
I saw that you purchased the Bräzeli iron. Will ship out Wednesday. But, to answer your earlier message, the plug is the original plug and my grandmother is the only owner. She needs to move/downsize so most of her estate is being sold. It's been fully tested and this is not a best offering and priced below value but if it doesn't sell in next 30 days, please check back. Please let me know if you have any further inquiries.

04/09/18: Hi me again. You said you tested it. Did you make sure upper and lower plates heat independanlly ? And also does it come with the drip tray ? Thank you. David

 

The listing stated it was only the unit, fully functional, etc. (no accessories and photos only included unit). 

 

I replied:

Good evening,
Yes, it was tested for an hour on Saturday to ensure full functionality prior to listing. Plates heat up independently to 500 degrees, I assure you I would not list something that is not fully functional. Sorry, nothing extra included, listing was for the Bräzeli only as listing describes. Will ship Fed Ex ground in a sufficiently packed box for it is heavy and do not want any damage during shipment.

 

The item was used condition but using thermometer heated up to 500 degrees as hot as it's supposed to for making swiss brazeli. Very well made item, highly sought after.

 

04/09/18: A little nervous as I bought a ''new'' kitchen item $$$$ a couple of years ago off of Ebay
and it was a nightmare....Looking forward to using this gem..Sorry for all the questions. Good night

I replied: sorry about your previous experience and assure you it is properly working. Will ship off tomorrow. 

 

04/13/18: greetings unit arrived...listing says, " no dents or major scratches". ???? huge chip in front by handle...and tiny chips on left side..i don't mind the tiny ones on the side..BUT i think you should have mentioned the huge one in the front......

 

He sent photos of the damage (which clearly look is if a screwdriver was used to chisel at the very thick metal of unit).

 

I sent photos that showed the unit was clear of this damage in the areas he says are now damaged. 

 

He then said that it was likely done during shipment. 

 

Okay, so I file a Fed Ex claim. Sent all his photos, my photos, photos of how I packaged it, etc. Fed Ex said it was packaged well but denied claim because there was no damage to the exterior or interior box. And, the unit was wrapped in 6 inches of bubble wrap all around and cushioned with 5 inches of crumpled newspaper around unit inside the box. Essentially, it was packed so well that they felt the damage claimed could not have occurred during transit. 

 

I let the buyer know and offered to appeal. I photographed how well I packaged it because I knew he would try to pull something based on his previous emails. I didn't say anything about refunds at this point but in his next reply he requested a partial refund and to keep the item.

Without waiting for my reply, he sent another reply immediately after: hello
for what it"s worth...i have heard they [fedex] are very difficult to deal with ,as far as claims go-
i am very sad..'been wanting one for so long....i hoped it to be perfect..for the money spent-
most would say it's no big deal..but it is to me [use to have a round one] hope they work with you

I replied: Hopefully, Fed Ex accepts the claim after appeal. If this is the case, I will certainly refund the price of the claim reimbursement to your Paypal. The estimated claim process time frame is 5-10 business days. Please know I will send an update upon their appeal decision.

 

04/24/18: Fed Ex took 9 days to reply to appeal. It was denied. Before this point, he had sent 2 more emails about how disappointed he was and would like a partial refund before its too late. Both of which I replied that at this point he could return the unit for a full refund once it was received. I also advised that it was up to 10 business days or more for Fed Ex to respond. At this point, I was at wits end because I already told him no partial refunds but return for full refund, I pay return shipping.

 

04/26/18: 

Ebay told me to open a case now. . I have heard nothing from Fed Ex and very displeased Item damaged and heating much to slow. I have sent 2 sets of photos and the longer I wait the lesser my chance to returns. Let me know if you're willing to offer a partial refund. Getting ridiculous. Thank you David.

 

I replied again: about returning unit and advising him to open a case because now he was stating functionality of unit (not just cosmetic damage) is slow. 

 

04/30/18: Morning- Don't really want to give it up,,,The whole thing makes me sad. I waited so long for one-I just would like some compensation for the damage..I can still use it ,-just not as hot as I think it should be. Most of the folks in Germany won't ship one here. I love my Beater Brazeli.. Have a Blessed day. David

 

I've asked him to return the unit multiple times, I will pay return shipping. He's not willing to do so. Because of the photos he sent of the damage (before anyone questions whether he is trying to scam me...yes, it is very clear he took a knife or screwdriver to the unit's metal. It's precisely chiseled out on thick metal coating of unit, in areas like right under handle, which was perfect before shipment. Packed too well for this to have happened. Box had no damage).

 

I guess I'm posting to show people what some Ebay buyers will do for a discount. He'll most likely leave negative even though I've spent countless hours filing/following up with Fed Ex, following up with the buyer after every single email he sent. Good grief. Almost done with Ebay.

My opinion with this scammer is he already had an identical damaged item and wanted to replace it with your item. He then took pictures of his already owned damaged item to make it look like you sent him a defective product to get a refund and that's why he won't return it. Your item shipped perfectly and is most likely still in the same condition you sent it in.
