Usually this happens when the buyer mistakenly files an Item Not Received claim. The correct dispute is Item Not As Described. If this is what happened, call eBay and explain; they should be able to start the correct claim. If not, go to paypal, and again file the Not As Described claim.

The info above is very good direction ... simply, you probably made a mistake in filing a claim, but these are a couple of steps that you can take to correct the mistake and get your money back.

if you file INAD with Paypal,you will have to return the empty bag with tracking.
if you file chargeback with your cc issuer,your seller will lose and pay $20 chargeback fee.

And the reason for this is you did receive SOMETHING, and tracking states as such. That's the reason for the not as described case and not item not received. You did receive something - an empty envelope ![]()

I unfortunately filed asking for a refund, because all I recieved was an empty package. I did refile as "Not as described" and recieved a refund. Thank you for the help.
The seller was belligerent to say the least. He said that he never sends empty packages and that he and his wife never make mistakes. It had to be my fault or the postal service. He said that I need to ask my mail carrier about it. He had a 99.7% rating and was very proud of it.
I really wanted the item and he would not work with me.

If he is at 99.7% then he has made a mistake or two.
Most likely the mistake he made with your package was not sealing it properly.

there is no such thing as never make mistake.
has the envelope been tempered?
it is not unusual the seller cannot locate the item or it has already been sold,items are often listed and relisted many times under different IDs on ebay,if there are 2 working to gether,one could have sold the item without telling the other.

I am having this issue with a specific item that is purchased in Puerto Rico, On this one specific item, I sell 15 a day and 10 of those sells are from Puerto Rico. I tape the **bleep** out of the envelope but yet it still arrives at the buyer empty.
So it may not be the sellers fault in this case. I tihnk there is a rise of scamming it would be interesting to Trend this somehow.
