I recently purchased from a seller, upon receiving said items I noticed they were not right. In comparing my items to an authentic item supposedly the "same" item, I noticed differences in many different areas. I messaged the seller 3 different times and didn't receive a message back. I have now put in a claim for not as described and have to wait. The sellers status says returns not accepted, but I want my money back. And I want eBay to realize these items are counterfeit! I fear returning to the seller so they can turn around and resell these items again.

When an item is counterfeit, the seller's "no return" policy is out the window.
But before filing SNAD, make sure your suspicions are correct.
If the item is proven as fake, file SNAD and the seller will have to cover your return shipping costs too.

When you open a SNAD claim, the seller has 3 days to respond.

I bought sunglasses from a user on here and found out they were counterfeit just last week. I bought them in 2015. If they were real they would've had a lifetime warranty and would've been covered. I contacted the seller and he won't reply to me because he knows the 90 day return policy is over with ebay. I can't even write a bad review of him now that the 60 days have passed. Not sure if you have any advice but I am just so bummed that I have been had!

Not sure exactly what 90 day return policy you're talking about. Ebay gives you 30 days after the actual delivery date to open a claim while PayPal gives you 180 days after the transaction date to do so.
No one, including a credit card company, will do anything with a purchase that's 2 years old. Sorry.

Here's a shocker for you. (Don't be surprised if eBay deletes this reply) Did you know it is a USA federal crime to knowingly transport through the mail any counterfeit item? Even if it is back to an eBay seller as a return. If you receive a purchase that you thought was genuine but when you receive it you determine it is a counterfeit, contact the seller and ask for a full refund. If the seller says return it, make it clear that doing so would be commiting a federal crime. If the seller refuses a refund open a claim through "Resolution Center" and explain why the product can't be returned.
Most of the USA sellers listing counterfeits know they are selling counterfeits. How can you tell? Check their negative feedbacks. Once again.... has eBay suspended major offenders-you ask? NO.....duh! I've politelty contacted them before asking them to end their listing. Their reply...mind your own **bleep** business. Funny! I'm an American. Doing what I can to help Americans is not only my business but a moral and ethical responibility. eBay's executives don't have a clue what either one of those words mean. MONEY, MONEY, MONEY, MONEY,....that's all they know even if it means selling out the greatest country in the world.
I've been disgusted with eBay totally ignoring reported counterfeit items for the last 5 years. I have reported HUNDREDS of items. how many removed? ZERO. I'm sure they have some extremely complex legal loophole they use. Where are these counterfeits coming from-you ask? Mostly China......duh! (Go ahead eBay prove me wrong. I dare you.) One eBay employee could spend 2 minutes going to the American products website and verify that the item being sold on this site is a counterfeit. Will they-you ask? NO......duh!
eBay's turning their back on their own policy has made eBay millions at the expense of honest tax paying American businesses.
Here's something to consider. How is the sales tax paid to China sellers going to be collected?

Sorry, this is not a solution eBay. I'll gladly challenge you on this one. If eBay recommends the buyer return the known counterfeit, eBay is recommending that the buyer commit a crime....illegal transport of a counterfeit.

eBay will only refund the buyer without a return if there is significant evidence it’s fake If eBay doesn’t think it’s significant enough which is usually the case they will require a return and if the buyer wants their money back they will have to return it. It’s illegal to use mail system to send counterfeits in order to profit. Returning a fake would not fall under that.

Unless you are an on the books ebay official authenticator it doesn't really matter what you think about the item being fake or not.
You just have to go through the same process the rest of us schlubs do.
