Can I start a claim with usps for missing package

I have a buyer who has not received a package yet tracking shows it was delivered. We started a missing item claim with usps and usps quickly closed it within 24 hours saying they did indeed deliver it. eBay has sent a “generic” message that I should refund the buyer and then will have my final value fee credited because I have guaranteed delivery on my items. So I am responsible for the cost of a lost item? Even when eBay has guaranteed delivery? 

So... can I file a claim with usps given it was sent priority mail and hence is insured? Thank u. 

Given I pay eBay a monthly subscription fee, they take a percentage of my revenue & their rules are clearly in favor of buyer 90% of the time, I frequently wonder why I continue to sell on this site... just once eBay should pay for something. If they guarantee delivery and the seller can show it was sent properly with tracking- they should reimburse the buyer!

The insurance claim will fall as quickly as the missing mail did, as it shows delivery.

 

I have read that there is an appeal to this which involves the person getting(supposed to get) the package signing forms attesting to not getting the item.

 

You do not have to refund the buyer if the item shows delivery. eBay provided a message saying you "SHOULD" refund. Makes for happy buyer/happy eBay, but it is not a "must" refund.

 

Suggest to the buyer that they check with the PO to get info on the GPS location delivered to.  Maybe mis-delivered. Maybe stolen after delivery.

 

If a INR is opened on eBay you must again provide the tracking # that shows delivery. That should close the case automatically within 24-48 hours. After loading the tracking, you have the option of calling/using the "call me" to speak with CS to have the case closed in your favor.  Calling at this time may be delayed because of high volume calling for the new GTC policy.

You as the seller are responsible for getting the item to your buyer via your carrier.  Your carrier says they have done that, and that is technically where your responsibility ends.  If the package was stolen, or scanned incorrectly, that is not your responsibility.  Give ebay a call and tell them you want to close the INR case.  They will look at the tracking and close it for you.  After that you can either drop the issue and not worry about it, or continue to help your buyer track down the package, or fight a claim with USPS.  First things first though, take care of your account, and yourself and get the case closed in your favor.

We are going through the same thing. Tracking shows delivered in/at mailbox. The buyer says they have video of the delivery and later someone hauling it off in a bag with handles. Well golly gee, what am I supposed to do 1,000 miles away? I showed all of this to our postmaster and she took it to her higher up. We are told there is no claim after tracking shows delivery unless it is damaged. Buyer is required to provide a secure location for delivery. A case was opened and we entered the tracking number. Did you do this? We are still waiting to hear from Ebay. Hope this is a good outcome for both of us. Andrew

You are not responsible for a package where tracking shows it is properly delivered (or delivery was attempted).  It is the buyer's responsibility to properly accommodate the delivery .... that is, to accept the package and to provide a safe location that is not vulnerable to theft.

 

(I'm not sure why you received a Guaranteed Delivery message ... unless you are the one Guaranteeing delivery rather than eBay).

Since the item was shown as delivered, then it was most likely stolen.  If the package was stolen, then the buyer can file a claim.  I've heard that USPS insurance will sometimes cover stolen packages.

For a package that is successfully delivered, eBay favors sellers nearly 100% of the time, so long as you provide the tracking to eBay that demonstrates successful delivery.

You should be off the hook, but USPS, FedEx, and UPS are all full of it if you ask me. I can't tell you how many times I have gotten someone in the neighborhood's package and one of those above companies swears they delivered the package correctly. Obviously they did not if I'm holding it in my hands and returning it to the correct address.

I would not recommend delivering packages to your neighbor. If mis-delivered - write on the box misdelivered, date and redeliver and circle the address. Give it back to the post office/fedex/ups.

Just my thoughts on it.

I hear your pain. The only thing I will recommend is what I do. Require a signature at delivery. Decide at what price threshold you are willing to write off with a refund if you get the old "item not received" claim. Insurance is for the old "item damaged" claim, though I believe it does cover theft of an item - I seem to recall package stolen being an option for a claim.

The unfortunately reality is, as sellers, we simply cannot trust our buyers and not knowing where they live, the area items are being delivered to.

Anyone can file a claim.  The trick is to win.  One could win if the PO left the package in a negligent manner.  Like leaving it by the curb and admitted it.

My understanding is that USPS will (would?) pay insurance claims when a buyer swears up and down and signs an affidavit that states that. That may not be the case so much anymore with USPS GPS data on the delivery being able to (sort of*) show the item was not misdelivered down the street.

*sort of because there is anecdotal and tracking deduced evidence that indicates carriers are not always necessarily scanning pkgs as delivered at the delivery location (scanning the whole lot before hand while having a smoke break in the parking lot at the local Tastee Freez.)

Similar to eBay, PayPal, or Amazon buyer protection having limits, make too many of those insurance claims with USPS that you didn't get your package when tracking shows delivered, and you will find you get no packages - they will invoke the "no safe receptacle" (or whatever it is) clause, and start requiring package pickup at the PO.
