First time poster here! I've got a buyer who purchased a phone from me, in for parts or not working condition. In my description, I specifically said that I would not accept returns due to the part that I said was not working, not working. This buyer has opened the case of the phone already, and wants a return. Any advice?

Your return policy says 30 days, then you contradict yourself.
Even if you had No returns, in the the real part. The buyer can return if it's not as described. Sorry but you will lose. The buyer jumped on your listing because of the contradiction. Ebay's MBG Trumps your.

If its the Apple Iphone 5s, accept the return. You actually state this in the item description "This item has some odd quirks. While all the internals are fine: bluetooth and wifi work perfectly, the phone (cellular) works perfectly, and the screen LOOKS fine." You may have listed for parts or not working but you also stated the phone works fine. had you not said that, you probably could have fought the return and won.

That makes a lot of sense, thank you. My only question is since the buyer opened the phone, something (like screws) could be missing or the phone could not be in the condition I mailed it in. What should I do if the item I recieve as a return is not as I shipped it? Also, the buyer also tampered with the software on the device too.

I don't find it confusing at all. I would refuse the return since parts or not working is parts or not working.
If you have anywhere in your listing you accept returns though...you gotta take it back, even if they didn't like the brand of tape you used.
This is one to fight for and "winable". Just make sure you get USA based CSRs

The only way to make no returns stick on eBay is to sell for parts or return only AND have a "No Returns" policy and even that does not guarantee that you wont get a return request for SNAD and lose. It DOES guarantee that you won't get a buyers remorse return.

In addition to the return policy, the seller states the phone works. The only time I have seen sellers lose when the listing was for parts or not working, other than when they list it in the used category, is when they state that the phone works and the buyer claims it doesn't. Or that the screen works and the buyer says it doesn't. Had OP not said the entire phone works, and had he not had a return policy, this would have been winnable.
