I sold an item, listed it as damaged packaging. Buyer opened a case, saying he wants a partial refund because packing is damaged. I decided he should return the item, and just get a full refund. I got the item today, it's beheaded, and missing accessories. Is there anything I can do? Or am I out of luck.

It sounds like the item was intact when you shipped it to the buyer. Do you still have pictures from the listing showing what it looked like originally? It sounds like the buyer damaged the item because they were upset they had to return it. I believe eBay has a money back guarantee policy. Technically, the buyer really shouldn't get any refund. You were honest and said that the packaging was damaged in your listing. He really shouldn't get ANY REFUND at this point. I would contact eBay before going the next step. What would I do? The buyer wouldn't get any refund because it sounds like they damaged the item and took some of the accessories before sending it back to you. You were honest in your listing from the beginning. It doesn't sound like the buyer is though. Contact eBay.

You don't have many options. You can go to this page and read about issuing partial refunds when buyer returns an item in damaged condition. but if the buyer objects, you can't do much.

I just noticed the packing he sent wasn't even the same figure, he kept my figure, and replaced it with a different one.

Wow, so the buyer didn't even send back the original figure he bought? That's pretty low. It sounds like you got back something that was lesser than what you originally sold the buyer. That being said, I don't think he would get any refund from me just for that. That is dishonesty.

Read the seller's post below. If it were me? NO refund for the buyer. Sounds like a switcheroo happened, and the buyer sent back a different item that what they originally bought.

I attached photos of what he sent me to the case. I asked for a review as the item returned isn't the same as what I sent him. Ebay, said they need 48 hours to review. Wish me luck. I've been selling for around 4 years now, and I have never had a person do this to me. I'm still in shock.

eBay closed the case. They returned my money, and still gave the buyer a refund out of their own pocket. I don't really care much for him getting a free figure out of this, and probably scam some other seller in the near future. But I am happy eBay returned my money, thank you for all of your help.
