I sold a camera to a buyer, the item was shipped out with everything included in the description and I verified it was in working condition prior to shipment. A week after the item arrived, the buyer claimed it didn't turn on. They submitted a return request. I messaged the buyer a question, but never heard back so I accepted the return. They sent the item back but it was missing all the accessories I sent with it, and they sent the DSLR camera back without it's front cover which protects the sensor. The sensor is broken now because of this, although the camera DOES actually turn on which they claimed it didn't. Now this buyer is reselling the accessories that they didn't send back with the package on their OWN ebay page! They are making money off my items that they kept! I submitted a case to ebay, but they refunded the buyer. They also refunded me due to "not returned in original condition". However, I still want my items back or the buyer to be taken down! I reported their listing, but is there anything else I can do?? The listing is still up. I know it's my items because my memory card they kept has bubbled laminating on it and the picture they posted has bubbled laminating on it in the same spot and the same memory card.

Why do you think you deserve the items back? You were made whole.

I suppose if you want them bad enough, buy them.

Be grateful you were refunded, why would you think you should get the items back too?

Hi OP,

Not sure what the other posters on this thread are talking about, but I understand the outrage.

And I agree. If eBay had any sense, the listing should be taken down.

Not a lot of empathy on this topic. I feel for ya. The buyer was a crook and hopefully you blocked them. As other posters noted, you were made whole by eBay so by default, the items really belong to eBay. They chose to reward this buyer and that buyer is making money at the expense of eBay - not you.

You have a right to be salty.... really. The fact is, if what you said is accurate then eBay really should have banned that buyer from eBay. The fact they didn't just means at some point, someone else will be a victem of this buyer. Eventually the activities will catch up to them. In the mean time, as the other posters noted, be grateful you were made whole and drive on.

If I am understanding the OP, ebay made the OP whole in the transaction by paying the entire sales amount to them. They also allowed the full refund to the buyer. So the buyer got their money back and kept the accessories which were worth more than the camera IMO, and then they paid the seller for the total amount of the transaction Thus, eBay owns the items as eBay paid the seller for them 🙂

Title to goods do not pass to a thief, by having possession.

Logically, since ebay paid the seller the cost of those goods, & seller accepted the payment from ebay, effectively ebay may be viewed as having purchased from the original seller any existing ownership rights to those goods he may have chosen to exercise in future for return by the person currently having possession.

eBay should have ended the listing.

The seller in this case acted in bad faith. The took items they got from another listing for free that they should have returned. I'd kick them off eBay forever if I were in charge.

We have been in this situation where the buyer was given a refund claiming the item had not been received, and later saw that he posted the same item, using both the photos and description from the original sale. When questioned, the buyer did a little dance, whined and complained and made efforts to blame everyone but himself. We filed a police report locally and it will make any visit to Thailand extremely unfomfortable for him. eBay was disinterested in the whole thing. Why would they delete the listing when its sale could generate revenue in the form of fees.
