Buyer returned a product to the Seller, claiming it did not work right. Seller agrees to the return and will refund his money when he receives the product back. Seller does not ever receive the product. Buyer has the Federal Express tracking receipt. So, the conclusion is that Fed Express left it at the front door and it was stolen. Buyer did not purchase extra insurance from Fed Express. Value of the item was $325. Because the Buyer did not buy insurance nor did he require a signature, isn't it his responsibility to do this? Should the Seller refund his money?

If something was stolen off seller property, seller needs to contact the police and file a claim with their homeowners/renters insurance.
If it was scanned delivered then it was delivered. Case closed

^^^ Who concluded that? ^^^ The buyer, or did you check with FedEx? The seller will have to refund if the buyer can prove delivery.

The Seller concluded that it must have been stolen because the Fed Express receipt indicates they delivered it to the front door.

The first thing I would do is check with Fedex to find out if the package was actually delivered to their address. All eBay looks at is whether a package is delivered. Fedex usually provides insurance up to $100 but if a package shows delivered they will not pay. There is no requirement for any party to pay for insurance. The same thing happens when a seller ships a package to a buyer. If it shows delivered there is no compensation to the buyer unless they can prove it was delivered somewhere other than their address.

Yep, this is correct. Buyer had no obligation to purchase additional insurance. All that anyone focuses on is the delivered stamp. You will need to refund the buyer for the item. If you don't eBay will do so on your behalf and take the funds from your account. If buyer has to open a case via PayPal or their credit card you will also be forced to fully refund, plus you may be charged additional fees for that. Best of luck to you....

The buyer's obligations on a return are exactly the same as the seller's obligations after a purchase. Signature confirmation is only required when total purchase price is $750 or more. And when the carrier scans the item as "delivered", that meets the delivery requirement. The seller is required to have a secure place to receive the delivery, same as the buyer.
Unless the seller can get documentation stating that the package was not addressed to the seller, the seller needs to refund the buyer and then deal with FedEx to see if it was misdelivered.

So you're the seller? The buyer can verify the exact address it was delivered to through FedEx, too.
