Brake Overstock - extra costs incurred question

Hi Everyone, please give feedback on my experience and whether I am entitled to a reimbersement for costs incurred:

I purchased a set of 4 brake rotors from Brake_overstock on the 6th of April. They shipped the item to my drop ship location in Oregon, it arrived on the 12th, tracking number 718430048076. My drop ship location in Oregon then onships the package to me in New Zealand, this solution is used for sellers who will not ship international or if the international shipping estimate is far to expensive. The packaged arrived and I then onshipped it to me in New Zealand for an additional $130USD. The item arrived here approx 10 days later and I was suprised to see that only 2 rotors had been sent, it was missing the other 2 rotors. I contacted Brake_overstock who did not reply. Then 3 days later another package at my onshipper in Oregon. I have had to then pay an additional $130USD to sent the second pair of rotors over to New Zealand. If I had received both packages under the only tracking number I was provided from brake_overstock then they would have been combined into the same box as it is charge by volumetric weight not actual weight and the pair of rotors only took up half the size of the box as the box was intended for 4 rotors. My question is whether they are liable for the extra onshipping charge as I was never informed it was 2 seperate pacakages, also I wasnt informed they would arrive 2 weeks apart from each other, and I was also not notified of a second tracking number or that the first package was one of two under the original tracking number. I have contacted brake_overstock via email and ebay, the best they offered was a $25 voucher or I could return the product. The problem is if I return the product then I am left with nothing except another $130USD shipping charge, why would I want to have no products and $260USD in debt. Brake_overstock wont take ownership and ebay closed the case because I didnt ship back the product, for obvious reasons. My only option now is to call ebay and incur more costs which I doubt will render a result from what I have read about ebay phone support online. Please advise my best approach.

If Ebay has already closed the case in the sellers favor, you have no way to collect any refund on the two shipping costs,take the $25.

No, they are NOT liable for your reshipper's costs. All they are liable for is shipping to the transaction page address.

Your expenses for the re-shipping service are on you.  The seller did not charge you any additional monies for the 2nd package due to their initial error (as they shouldn't have) but their liability stops when the package(s) gets to the US destination. 

 

I really am sorry it didn't work out well for you.  Unfortunately, you assumed the risk when you contracted a third party.

Hate to say it but you own this one. The original problem was corrected by the seller when they shipped you two more rotors to your address - and presumably ate that shipping cost for doing so because it sounds like that was their mistake. But they have no control over the fact that you are reshipping stuff. How or when you do that is up to you.

 

Maybe you could arrange for your reshipper in future to open your shipments for you and verify they are complete before sending them on to you. That would be between you and your reshipper to set up.

Yep, this is all on you. The seller is NOT liable. This is the risk YOU take when you use a forwarder. You are lucky the seller willingly corrected their mistake--you forfeitted your buyer protection when you had the items forwarded to you. You have no recourse here and the seller isn't responsible for your additional costs. You assume all risks and liabilities when you use a forwarding service. Ebay wouldn't help you with this period, even if the case was still open. You would only have been able to return the items for a refund of the item price + original shipping paid to the seller. You would still be out the cost of forwarding the item. Consider it a lesson learned. And remember, the money back guarantee does NOT cover you when you used a forwarding service.

I agree with everybody else. Sellers responsibilty ended in Oregon. They were very generous in offering you $25.
