So I bought a video card, an old one, a 9800 Pro to be excat, its a counterfit, talked to the seller and it's being returned, its been out for delivery for 2 days. I then realized ebay's policies say not to return a counterfit item, also the seller has left the listing for these counterfits up, he assured me they would take down the listing so no one else got burned. What is the best way to approach this, I know the card was countefit because the PCB was not correct, and the RAM chips where 3.6NS instead of 2.8NS. Anyway to get the listing for counterfit cards taken down, and did I commit a crime by returning the card?

eBay has no policy which states counterfeits cannot be returned. The MBG says that eBay may not require you to return the item when there are strong indicators the item is counterfeit. It’s not illegal to return a counterfeit item either. eBay rarely tells a buyer not to return the item in this situation because it’s really the buyers word against the sellers and eBay can’t inspect every item and verify it’s authenticity.

No. You did not commit a crime by returning the card.

Unless eBay instructed you not to return the item, you were correct in returning it.
If a buyer reports that an item is counterfeit, and there are strong indicators that the item is counterfeit, we may not require the buyer to return the item to the seller. The buyer agrees to cooperate with us to ensure proper disposal of the item. In such instances, we refund the buyer for the full cost of the item and original shipping, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.

Thank yall for your anwser, never thought I'd run into a knock off on such an old card, who knew people where making counterfit video cards from 2003 lol.
