Bad e-Bay decision

I consider the solution given by e-Bay to be absurd for the following case:

 
eBay Customer Support has made a final decision.
The seller provided tracking information that shows the shipping carrier tried to deliver the item to your address. You can pick it up from the shipping carrier.
Final decision: A refund won't be issued for this case.
Request reason : Item not received
Case reason : I haven't received a refund for the item
 

The reasons why I consider the measure taken by E-Bay to be unacceptable are the following:

a) In fact, the delivery track say: Return to the sender processed.

b) On June 7th I sent a message to the seller requesting a refund because I was no longer in the United States, where the delivery should have taken place (I live in Brazil). Therefore, I am not in the least position to do what e-Bay recommends that is to pick up the product on the carrier. By the way, I do not even know if it's there since it's on the track like "Return to Sender Processed"

c) I got refund for all other purchases that were not delivered due to problems with the USPS that decided not to deliver several products at the address originally provided (while other shippers delivered). It must be emphasized that it was a problem completely beyond my control.

d) In summary, I will be charged for a product that I will never receive and that probably was or will be returned to the seller.

e) the value of the product can be whimsy, however, it is a huge shock to my belief that it is safe to buy through e-Bay.

Tracking you posted shows that your address was vacant on May 23. Did you move out before then? The package tracking says Return to sender although it has not been received by the sender yet. They should refund you when the package is returned but it does not look like they have the package back yet. Return packages can be very slow.

Your seller did not send to your address @lindamiverbisk_0 but instead sent a fake package to a nearby address, hoping to make tracking show Delivered. Unfortunately for the seller, the post office realized that that nearby address is Vacant even before the fake package went out for delivery, and processed a Return To Sender instead, although it's likely that the sender's return address on the label is fake as well.

 

You lost the Item Not Received case at eBay, and you won't win it at PayPal either. Rather, the best way to get back at your seller is to file a credit card chargeback, if that's how you paid. Call the number on the back of the card, then request a chargeback using the reason Goods Returned Credit Not Issued, and provide the tracking showing Vacant as your supporting documentation for the chargeback.

 

Being in another country is irrelevant: Your item was not delivered to the address you specified, regardless the country of that address.

And just how do you know the seller didn't ship to the address the Op had on file?

In your case, you are charged because you purchased an item and did not accommodate the delivery.

 

eBay is following their generic rules and policies, though I realize that eBay's rules do not cover the nuances of every situation.   The generic rule is that an item is considered "delivered" if it is actually delivered or if there is a reasonable attempt at delivery ...

  • It is the responsibility of a seller to ship an item to the address given by the buyer.   The seller did this.
  • It is the responsibility of a buyer to accommodate the delivery of the item that they purchase.   You did not do this.  You provided an invalid address, and thus you did not accommodate the delivery.

With that said, many sellers that get back an undeliverable item will work with you and give you a partial refund of your purchase price minus expenses (shipping and eBay/PayPal fees).  This is not much different than a return, though it is more costly for a buyer because the buyer is responsible for the mistake.  Keep in mind that a seller does not have to refund anything because this is outside of eBay's generic rules and policies - it is not enforceable - so be polite and contrite and accept responsibility for the mistake, and kindly ask your seller for some mercy.

Ebay sucks when it comes to resolving international problems such as refunds. I ordered an item from India. Took two months to get to US. Once I received item i was unhappy and promptly returned. It took 2 months to get back to seller. Not my fault slow USPS. Both seller and ebay say "aw so sorry no refund" WTH. Seller states the item was recieved ...whats the problem return my money

This isn't an international issue. The Op had a US address, but left the address before their item was delivered.

The Op should have either left forwarding instructions or made sure all their packages would arrive long before they left.

OPs item was purchased on May 21st. The attempted delivery was on May 23rd. The OP already left the USA by then according to their post. 

This is the OPs fault. 

Ebay considers the item delivered when a delivery attempt is made.

 

YOU should NEVER have ordered the items if you cant follow through with your end of the agreement.

@lindamiverbisk_0   this situation was COMPLETELY in your control. Just because others refunded you for not collecting your mail, doesn't mean you were entitled to a refund for not collecting your mail.

Ignore all the barbs and wrong guesses @lindamiverbisk_0 as you will get your refund after you open then immediately escalate a PayPal dispute for Item Not Received at:

if that's how you paid. Unlike eBay, PayPal only considers your item delivered when tracking actually says Delivered.

 

1. Find your payment at PayPal > Report a Problem

2. Didn't receive, Physical item, enter the tracking number

3. View Message History > Escalate to PayPal (bottom of page)

 

And you're done; just wait up* to 10 days for your refund.

 

*PayPal allows your seller the dignity to refund before it is forced

I don’t know where you got the conclusion that I was wrong.  I've given them the correct address.  Other carriers like Fedex, DHL, UPS have delivered all the products I bought at the same address that I had reported to this seller, including the same day that USPS said that the home was vacant. The problem happened because USPS did not deliver under the claim of vacant home. So, it was not my mistake.

This is not what happened. I was still at the address when USPS registered home vacant. That same day I received other purchases delivered by Fedex, DHL and USP.

I left USA only on May 29. On May 23 I was there and received all other purchases delivered by carriers such as Fedex, DHL and USP. So the fault was not mine.

Thank you for the exact understanding of the facts that really happened and for the sensible orientation to obtain the refund. However, it is not possible to use PayPal because the payment was made directly to e-Bay with a debit card. Many thanks
