I sold a massager on March 23, the buyer wants to return it, I had an automatic return on the listing but the buyer is saying that it does not work and is defective, later in details she says that it works but it makes her hand tremble to much. Can I fight this return once it is returned? will I be charged for the return shipping because she said it is defected and not working? but she is contradicting herself also when she says it vibrates. my return policy states buyer pays for return shipping and I have a restocking fee, will I be able to charge my restocking fee. Below is a copy of what she stated for her return.
Reason
Doesn't work or defective
Details
Thid item vibrates the user hand tremendously when being used hence causes numbness to the hands only minutes after it. This is a defect..

eBay will always side with the buyer. No use fighting it. I always block the buyer after one of these. I believe eBay will not allow a restocking fee, but you can always try and will be your call. I understand your frustrations on this type of return. Good luck!

Ebay did away with the restocking fee a couple years ago, so no, you can't charge them.

If the returned item is used damaged or missing any parts or is damaged during return shipping because it was not packaged correctly some sellers might provide a partial refund to account for the loss in the items value.
Read Full Policy below for more details and specific requirements by listing category.
Frequently Asked QuestionsYou can return the item if the seller accepts returns, but as it's no longer in the exact same condition as when you received it, some sellers might provide a partial refund to account for the loss in the item's value.

Your return policy goes against eBay's policies so you should remove that information from your listings.
Is the massager supposed to be that powerful? If it is and the buyer's misusing the returns system by filing a not as described claim because she just doesn't like it then you can report the buyer. Wait until you get the item back and test it - if all is good then report the buyer for filing a remorse return as a not as described return.
You're a top rated seller so filing the report through the return request will automatically submit the transaction for TRS protections. If eBay determines that the buyer was abusive they'll credit you $6 towards return shipping on one of your upcoming invoices. If eBay doesn't find the buyer abusive then they won't issue a credit.
You can withhold part of the refund if the item comes back in a different condition (if it comes back damaged or missing the box, etc). If the item comes back in the same condition then you have to refund in full. Here are eBay's guidelines for issuing a partial refund.
