1. I opened a case for Not Working item..for those who said I was confused what kind of case would you call this then?
2. I didn't even get to use the item
3. For those saying the seller will probably approve the return beofre I have to escalate case......I opened the case on Thursday and today is Tuesday and they keep saying they don't accept return and that I should have purchased a Square Trade warranty
4. I may be clueless as a buyer but as a seller with over 30,000 feedbacks who rarely has anyone wanting to return an item I am new to the whole case thing.

I would call it an NAD case.

Since it's a SNAD, the seller has to approve it. He doesn't have a choice, as far as I know.
There should be a link to ask Ebay to step in. It will show up after so many days, I forget how many. When it shows up, click it. Ebay will force the return.

eBay Policy states that the seller has 3 business days to work out a solution that is satisfactory with you (e.g., refund without return required, refund with return postage paid by seller, or replacement). So, counting:
- Friday 2/14 is business day #1
- Tuesday 2/18 is business day #2 (since Monday was a holiday)
- Wednesday 2/19 is business day #4
If the seller does not act upon this by midnight PST on 2/19, then on Thursday 2/20 either (a) eBay will automatically step in and refund your money, or (b) you will be presented with an option to ask eBay to step in, you do that, and then they will refund you money.
I hope that is clear, and that no additional threads are needed.
P.S. If the seller genuinely has 30,000 feedback, then they aren't stupid ... they do not want this to be escalated to eBay, and will try to trick you into closing the return. Don't do it ... my guess is that they'll refund on day #3. If they don't then they'll get a nasty defect from eBay, and experienced sellers know these are bad.

No I AM the seller who has the 30,000 feedbacks.....I'm just under my buyer ID, I was mentioning that although I am new as a buyer as a seller with 30,000 feedbacks I am usually on the other end of this. I usually refund buyers or accept returns right away...that is why I'm saying I dont know how this will play out.

EBay doesn't require a buyer to purchase a square trade warranty.
You are covered under the MBG for item not working, escalate for eBay to step in as soon as eBay will allow.

I tried to nicely explain the eBay money-back guarantee.
and all they said was I offer no returns and you need to have purchased a SquareTrade warranty or there's nothing I can do
