Am I protected as a buyer?

Recently bought a phone that was sent water damaged. Instantly returned it. Now the seller is claiming that I'M the one that sent the damaged item and opened an ebay claim, with photos. 

What should I expect in this situation? Is there anything I can do?

Did you file a not as described claim or did you return it to the seller without a claim expecting a refund?

If you opened a INAD return you are covered. Seller may try to withhold half and your return shipping which TRS sellers are allowed to do....but if you don't have a habit of faulty returns eBay will refund you the rest if you appeal it.

Yes, you should be ok.

It is. 

That is not one of the remorse return options.

So you are good. Again you will probably have to appeal if your seller is withholding some of your refund.
