i would like to see ebay monitor sellers who would not offer replacement of defective build before time ran out. even though i was asking them to remedy the problem, the ability to rate them timed out so i had no recourse.

Seller's can't always offer replacements.  And Ebay can't force sellers to have certain stock levels, so what you are after isn't likely to happen.

To protect your money you should have open a claim for a defective item.  Then your seller would have the opportunity to say return for refund, just refund you or offer a replacement.

On a personal note, dang that fingernail looks painful.  OUCH!

It is unfortunate but you're not going to find many sellers willing to simply hand you a refund even if the complaint is legitimate.  In most cases you will need to open a return or utilize the ebay money back guarantee by opening a case, that should get your seller's attention.
