It is unfortunate but you're not going to find many sellers willing to
simply hand you a refund even if the complaint is legitimate. In most
cases you will need to open a return or utilize the ebay money back

If the item has not been received after the latest estimated delivery
date, I believe that answer would be yes. I do not think ebay cares how
or why, all they care about is whether the item has arrived at the
buyer's address of record.
