scammed by buyer

hello i was wondering if anybody else has encountered a buyer who once purchasing an item (in my case a pair of boots) from you/your store  then receiving said item they file a claim of "item drastically not as described"  not with Ebay but with their credit card company that they made the purchase via Paypal. This happened to me almost a year ago and the buyer got away with it, they got to keep the boots , a full refund was issued. However Ebay had no idea that they had even filed a case because the buyer never even contacted Ebay it was all done thru their credit card company. I tried disputing it with Paypal but they said their wasnt much they could do . Anyhow i have been checking said buyer's store to see if they would try and resell the boots  and lo and behold they have the boots in question for sale in their Ebay store. At this point i don't believe i have any recourse whatsoever, unless anybody has any ideas for me.Any thoughts or comments would be appreciated.

That scam is as old as ebay itself.

 

If you are 1000% positive (and can prove it by comparing your photos to the listing photos) those are the boots that were "technically" stolen from you...I would contact the seller and let them know, that you know, they're selling a stolen item.

 

I would inform them that if they refuse to do the right/reasonable thing, which I would say is to return the item to you, that you intend to:

 

1. File a police report (you have their name and address) concerning the theft, and resale of, stolen property.

2. File a report with the USPS Postal Inspectors if the item sells and is shipped USPS.

3. File a complaint with eBay about the sale of stolen property.

 

I would never do what this person did to you, but if I did, and the buyer sent me an email about involving the police and postal inspectors, I would be nervous to say the least...no one wants their name on police/postal reports concerning the fencing of stolen items through ebay.

You have to check your PP account frequently and respond to these surprise surprise cases when buyers will go directly to PP instead of alerting you to a return request on Ebay.  PP will require that the buyer send the item back as long as you have responded to the case. If you dispute the return and you do not win the dispute they can at their discretion refund without requiring that the buyer send the item back. CC companies are notorious for awarding the item and the money back to buyers even if they make bogus chargebacks.

My most recent SCAMMER: "unitybaysales" reported my item was not new, scratched, and.. damaged.. After 11 repeated emails and my refusal to bend over to his obvious Scam for a refund he left a Negative Feedback.. All of my  High Definition photos all disprove his Negative Feedback Claims that the items my items I sent were : "NOT AS DESCRIBED. Listed as NOS & New Other. Also read his 11 of abusive claims of my being an "IDIOT" and a "LIER" in his messages. My listing said: “Opened Boxes - Most likely these are (New) old unused items.. These are in unblemished condition and still in their OEM boxes.”.. My listing also indicated: "These parts are being sold as shown, as is, with no returns.. If you have any questions about these parts, please ask those questions before making your purchase." The Buyer never asked any questions, 14 days after he received the items, only started his communications with false unproven claims in an attempt to get a refund and a free item to use and resell.. Proven by his photos of what he does.. Buy, alter and Re-sell the same items..
