return after refund

I sold a model locomotive for $100.00 plus $9.00 shipping.  The buyer said it arrived broken.  I was willing to refund his money, but he needed to return the item.  Well, Paypal gave him back his money in full, & told him to return the item.  He is not going to return the item.  Worse of all, Ebay is planning to give him a second refund on the 26th of this month.  Conversations with the buyer produce no results.  He has flatly stated he is not going to return the item.  Resolution center is no help. WHAT NEXT ?  SUE ?

I'm not familliar with pay pal cases but with the ebay case~~it was a SNAD case (item damaged) so the OP was required to send the buyer a return label.  If he didn't send a return label the buyer is not required to return the item.   IF the ebay case was in fact the only case the buyer had opened he would receive a full refund AND keep the item if the seller didn't send a return label.  Too many sellers believe the "buyer pays return shipping" policy~~not knowing THAT isn't always the case.

As a general rule, it is not true that a buyer gets to keep an item if the seller has a no return policy.  Think of the consequences for every seller with no returns if this were true.

 

A seller can choose to allow a buyer to keep the item or it might happen if they do not respond to a case.

I would be sure to 'accept' the return for the case through eBay, as they will make the buyer send the item back before making you issue a refund, and require the buyer to providing tracking showing they have done so.

 

And I would call Paypal, to inquire what exactly they have done regarding refunding this buyer, and why?

I think we all should have read the OP's other thread he started the day before he posted this one.  The buyer opened a "return case"~~OP agreed to the return~~pay pal refunded him the $109.00 the next day (??)~~ Pay pal shows the REFUND HAS NOT BEEN COMPLETED which means the $$ are just on hold in pay pal which is normal.  It APPEARS the ebay case will close on the 26th. 

 

The BIG question??  Has the OP issued the return label to the buyer??  The OP is responsible for return shipping on the damaged claim.  I'm sure the buyer does not want the damaged train car or they wouldn't have filed the return case.  IF the OP doesn't want the buyer to receive their refund AND keep the item he needs to issue the return label to the buyer.  Pay pal shows the refund has not been completed so it looks like the outcome of this case is on the OP's shoulders.

 

OP~~you have until 10/26 to issue the buyer the return label or ask ebay to issue the return label.  Then the buyer has something like 5 or 6 business days to ship the item back.  I'm sure the buyer is refusing to ship it back because YOU aren't issuing them the return label.

 

If, in the case, the return label tracking number hasn't shown the buyer has shipped the item back by the last day they are allowed to ship it, call ebay the next day and have the case closed in your favor and your pay pal funds will be released back to you.

 

Your buyer has NOT received a refund yet~~that will only happen IF you fail to issue the return label.  It was only $9.00 priority shipping so well worth the expense for that return label.  Your buyer has NOT been refunded.

I don’t understand PayPal refunding before the item is returned to you on their dime.

 

BUT you need to call eBay and point out the buyer opened a case on PayPal AND  eBay. EBay doesn’t allow that. 

 

A buyer of mine had a credit card dispute on PayPal and then later tried to open an item not received case on eBay for the same item. (I never shipped due to the PP dispute.)  Ebay closed that in my favor immediately while I was on the phone, due to dual claims. Good luck to you.

PayPal hasn’t refunded; they just put a hold on the funds, which is standard procedure. OP is being dramatic.

You're right Paypal has the funds on HOLD and the OP thinks that's the same as a refund.

 

I've had 2 items returned this year.

 

Both times Paypal put the money on hold until I received my item back.

 

The funds were only released after I stated I had received my items back and even though tracking shows the were delivered to me Paypal still waited until I checked the box that I received them.

I've had returns before (4 in the last 12 months~~one of which was never returned).  I haven't had a hold put on my funds for years when a return request is opened. My items are all low $$ though.

 

Back in July the OP posted that he had been below average for about 8 months and ebay wouldn't even allow him to open a store~~he had just below 5% defects.  Ebay tends to be harder on sellers with these ratings than on sellers with good ratings. 

 

If the OP doesn't issue the return label he is going to get yet another defect for a unresolved case and it very well could end his selling on ebay.  He needs to do what is required or he may be suspended permanently.
