listing removed for policy violation

recently had listing removed due to policy violation i was told.  it was cpap mask.  i am aware of not being able to sell cpap machines or anything that requires prescription.  masks do not require prescription and can be bought at many retail stores anytime.  also there are many other listings with masks and accesories for sale still listed.  just was looking for some guidance if anyone can help. thanks

A simple look at the Ebay policy for prohibited items would have answered this question.  Policies are available to everyone at any time.

In part the medical device part of the above policy reads:

 

Any medical device that requires a prescription can't be sold on eBay, including:

  • Continuous Positive Airway Pressure machines (CPAP), along with masks, humidifiers, heated water chambers, and heated tubing

All I can tell you is this: 

 

If an item is removed, legitimately or in error, do not relist it.  Ever.  Once an item has been removed, all your listings are on the  "bot" radar, seeking repeat violations.

 

Sell it somewhere else, or donate it, or whatever, but don't try to sell it on eBay.

i must have misread the policy.  thought only pertained to prescription items.  i am fine with the answer.  luckily my store does not depend on this product to thrive.  thank you for the clarification.  my only problem now would be how are the 100s of other listings allowed to be selling this same line of products?  just a thought.  thanks again.

If its a part that may itself be sold without a prescription, but was part of something that was a prescription item, they consider it a prescription item.  The cpap unit it goes with may be prescription, so its also prescription.

thanks for the heads up.  already aware of the horror stories of trying to relist.  its still sad that only select few are targeted and others are still allowed to sell the same product that was removed from you.

There was 100's plus 1 when your listing was still active, the ones that are still listed will get pulled eventually and others will replace them.

 

It's wack-a-mole for eBay to find the hundreds of thousands of items that violate policies amongst the BILLIONS of listings. If you want to help you can join the unpaid eBay police and report these offending listings (which is probably how yours was found and taken down).

Yes, it is annoying, I know, but with 20M sellers and 1.5 B listings, policy enforcement is going to be imperfect, to say the very least. 

 

And since it's done with primitive bots and bots driven by primitive AI, it's going to be positively whimsical at times.  Ask people who've had something removed because it is "ivory," when the item is an old Ivory Soap print ad or something made of plastic called French Ivory at the time it was produced (late 19th C /early 20th C).  😖

When it comes to its policies, eBay is not always consistent, its enforcement is scattered, and there is no transparency to its actions. Some violations fall tjru the cracks. Others will eventually get flagged. But it can be maddening to see  offending listings thrive when yours was removed. 

The best advice i can offer is to concentrate on one’s own listings and ignore what other sellers are getting away with. Read as many policies as possible to keep abreast of what is and isn’t allowed, and come here if you have any questions. Some of those policies can be vague, others confusing.

There are quite a few things that you can sell on one Marketplace but not on another. Maybe Bezos has a higher tolerance for liability litigation than eBay has or maybe he doesn't care if less than reliable sellers put "defective" and potentially dangerous items for sale on his site.

 

Right from the earliest days of eBay they had restricted/prohibited items that were legal and sold elsewhere.

Others are not allowed, either.

Someone reported yours and the others haven't been reported is why the others haven't  been removed. AND they may never get removed if someone doesn't  report them.

you are not worth enough to ebay thats the problem, sellers who promote their listing are valuable to ebay and they can do anything.

each of your customers money purchased thrpugh your sold items are not valuable to ebay because ebay havent earned much on you...

you will always be treated different than other sellers.
