if you go on vacation or in my instance end up in the Hospital Ebay penalizes you for late shipping. Which is absolutely Ridiculous, I always ship next day. I had emergency surgery and had someone put my store on Vacation settings and Ebay will take either away your power selling feature, or put you on Notice. I had thus happen to someone else I know also. This is Absolutely crazy... What good is the vacation setting if ebay is still going to penalize you for it?? Everything for Ebay and Zip for us! Really annoyed. Not right!

The basic vacation setting is merely an "Away" message. It goes back to the days before eBay used shipping time when evaluating sellers.
To protect your shipping time score, you have to either (1) revise your handling time to reflect your anticipated actual shipping date; or (2) use the option to block all sales of fixed price listings (and end all auction-format listings).

You have a store, so you have vaca settings available to you to avoid any dings on your account. Ebay does expect sellers to use those setting as they should if going on vaca, even for a couple of days. Your buyers can't possibly know your schedule. All they can see is what is on your listing.
When you had put your store on vaca hold forgot to HIDE your listings. The option is spelled out on the screen. If you only put the message on your listings and don't hide your listings, buyers can still purchase and they will expect the handling time stated on the listing as they should.
To prevent issues you either need to hide your listings or you need to edit your listings and extend your handling time.
Ebay didn't do anything wrong here. I know you are upset. But it just came from a misunderstanding on how the vaca setting works best for sellers. Now you know and you won't have this same problem repeat. You can share this with your friend too that had the same kind of issue.
BTW, when you are suddenly hospitalized due to an accident, sudden illness or whatever. No time to worry about Ebay when a serious life matter sneaks up on us. You can call Ebay and explain the situation. They may ask for proof, but you can explain and they may help you with any dings you may have received as a result. Not always, it depends on the situation and if you can prove it.
I sure hope your surgery was a success and that your recovery is swift.

Only if you allow people to buy your items sell while you are away or in the hospital. When I go on vacation, I end all my listings.

You should have also had them hide your listings.
Ebay will take either away your power selling feature, or put you on Notice
eBay will only take your Top Rated Seller status away if the number of late shipments is high enough for you to miss the metrics.
I always ship next day.

They didn't penalize you for using the vacation setting, they penalized you for not meeting your obligations while using the vacation setting. In addition to putting up the vacation message, you also could have hidden your listings, extended your handling time, or ended your listings.

hi, I think most of us at one time or other have run into the same thing when dealing with vacation and or unforeseen absences from selling.
-ebay does allow shutting down all fixed price and store listings so they can not be purchased during the absence … but you need to look closely at the vacation settings in order to make sure they are set right.
-this does not however end auctions. they will continue thru the auction cycle. nor do I believe you can 'end' and auction. you can however choose not to relist an auction that will run into the absence period.
-OR … you can change all your listings handling dates past your expected absence period in order to allow you to get everything mailed on time before you change the handling times back to normal.
