how do I communicate with eBay's VERO program?

The product verification program removed my listings that more daily sales had only because they think they are fake and did not ask or send to order a product to verify its authenticity only removed them, when I have receipts for the purchase of all products.

It's unfair.

Has something similar happened to anyone?

Hi there

Looking at your photos, are you drop shipping? Just taking a shot here.  Stock photos can raise red flags of all kinds.

These are credible, US CS agents who actually work for Ebay and can better serve you with your issue at hand.  Many positive posts on this forum with their ability to be helpful.

VERO is a program that provides eBay with immunity from liability for your listings on their site as long as eBay complies with the terms of the OCILLA act under the DMCA. 

 

Those terms essentially say that eBay must take down a listing if a third party reports that listing as a violation of their intellectual property rights.

 

Once that happens, it is up to you and the third party to hash out the disagreement.

 

eBay has absolutely no incentive to intervene on your behalf, because that would open them back up to liability.

 

All that aside ...

 

Receipts for purchase of a product do not prove that your listing does not violate someone else's intellectual property rights.

 

For instance, if you have a receipt that you bought a Bruce Springsteen bootleg at a store, that Bruce Springsteen bootleg is still illegal and violates Bruce Springsteen's intellectual property rights.

It's always been pretty much my understanding that the reason for VERO is to keep people from selling those items when they do not have the right to do so.

Even if your items are genuine....some brands only allow "authorized dealers" to sell their merchandise.  Do NOT relist these items or EBAY may terminate your account.

Looking at the quantities and variety of brands, you would be looking for invoices and not retail store receipts.

If your listing was a VeRO removal, the message you received will say that the listing was removed because the rights owner reported it. All VeRO removal messages have contact information located in that message that tells you to whom to respond if you believe that the removal/infringement is in error. 

 

Only the rights owner can contact ebay to get the listing reinstated if the takedown was in error.

Thought of something else: 

 

If a VeRO removal and if any of your listing use the company's copyrighted stock images and/or descriptions, that could be the root of your problem and if so, it's likely that using your own pictures and writing your own descriptions in your own words could get them to allow you to relist.

When a vero report is sent to the seller, there is normally an email address for the company that made the complaint. There isn't one in the message you received?

 

What exactly does the Vero report say? Listings could be removed because they believe an item is counterfeit or because they believe that you are violating their intellectual property rights. Were you using our own pics for that brand? If you were using there pictures, that might have caused the violation.

 

Although vero is not supposed to be used simply because the company does not want ebay sellers to sell their brand, some companies do abuse the process.

That would be illegal use of the Digital Millennium Copyright Act. Unfortunately the way the DMCA is set up there is effectively no penalty for this beyond the filing a counter notice and suing the company that filed the infringement notice.

What were the items and who filed the infringement notice?

 

Some takedowns are initiated by eBay itself (pre-emptive), most are initiated by a third-party and can only be resolved by the seller and the company that filed the Infringement Notice.

I understand the point but this is not the case, I buy directly from the brand's stores, and they also removed 5 listings for that brand when 75% of my listings are for the same brand. for them, 5 listings were fake and 280 listings were not.

They did not send the right of reply, only the message of deletion from the listing and the photos are mine, also many buyers download my photos and make their listing and there are several sellers selling the same product with my photos and they continue to sell and I am restricted.

Contacting the rights owner is the only course of action you can take.

Are you saying there was no contact info for the vero rights owner? If so it's mentioned in the help pages to contact ebay for assistance in getting the info:

What happened to my listing?

If your listing was removed based on a VeRO report, eBay sent you an email with details about why your listing was reported and how to contact the rights owner directly for more information. If you have concerns or questions about why your listing was removed, please contact the rights owner directly.

Contact us in the following circumstances

  • You can’t find the rights owner’s email address in your removal notification email.
  • You emailed the rights owner, but they haven’t replied after 5 business days.

Sellers are responsible for ensuring that any item they list on eBay is authentic and that the listing description doesn’t infringe on the rights of others.

Look more closely at the email or emails you got.  The contact information for the VERO holder should me in the email.  If it isn't, contact Ebay and they should provide it to you.
