getting scammed

I sold the ring on Ebay for $750 and I shipped it immediately. I did not understand the limitations on Ebay about the signer being needed for the amount of $750 or more. The buyer almost instantly made a claim that he had not received the ring and showed his intentions to try and get a refund. I then looked up his record and realized that I was being scammed. I have the packing label as well as the receipt from USPS that shows that the package was delivered. I googled the address and name on the shipping label and found a criminal background of the purchaser of the item which is long and extensive. Most of this is theft, breaking and entering, and grand theft auto. I know i may lose my money now but it is more about making sure that this does not happen to someone else. I know the States Attorney General and have sent her all the information in the case and she is seeing what she can do for me in the consumer claims division. I know she will do all she can for me. Is there anything else that I can do?

I have responded every time...not been out of the way at all and I have asked him to file a claim with his post office in person  

 

If you go to the USPS website and track the package, look at the details.  What does it say about delivery?   Left with an individual?   Delivered?  Left on porch?  What? 

It says delivered 

 

Did you ship this package insured?  If so, how much insurance was on the package?

No it was not...and yes I realize now how ignorant that was now...other than the $50 that comes with priority mail

 

What were the terms of the sale?  Do you have a Return Policy?   If so, what is it?

no returns accepted

I know you are upset and want to go after this guy, but I wouldn't call eBay CS yet.  Reason being is twofold which you may not realize as a new seller:

 

a) eBay has a process that must be followed.  You can't force anything to happen and eBay's CS reps won't intervene until a problem is at a certain stage.  Right now, all that has happened is that the buyer has contacted you.  (BTW, make sure ALL communication you have with this guy is within eBay Messaging - not by outside email, text, phone calls.)   At this stage, eBay does not consider your problem "official" because the issue has not yet entered what they call the "return flow."  The buyer needs to open a Return Request to start the process.  He hasn't yet.  Maybe he won't.  Maybe he will. But, until he does, eBay won't do a thing and TBH, you don't need to do anything either.

 

b) IF you contact eBay at this point not only will they not be able to help you, you'll get on their radar and very possibly the CS Rep will make a note in your file indicating you didn't get Signature Confirmation on your shipment.   Though I will admit, the chances are slim you'll be able to come out of this situation whole, if it were me, I wouldn't want to jeopardize my chances, however slim, by drawing attention to that detail at the start.

OP - did the buyer open a claim with Ebay for Item Not received or did they just message you that they haven't received the item?

 

If Ebay makes you refund and you just to warn others -  Report the buyer to Ebay for falsifying a claim. Go to the USPS web site and file a mail fraud claim - go online and file an IC3 with the Federal govt. and call the police department in his area and file a report for theft. If they have a criminal record - the local police will probably know them. They may be on probation and an activity like this would violate that probation. May not get your merchandise or money back but he'll get his just rewards.

The buyer opened a return request but it was for item damaged...this is what was listed 

There's something wrong with the item your buyer's received, so they'd like to return it.Please take action by Apr 09.

Im wondering since he filed the claim for item damaged and I have a no return policy does that make a difference and does it give me more leverage

@rowtid,  At this point is time I would quit communicating with him.  If I were you, I would call his post office and talk with the Postmaster.  Explain the situation (recipient says package was not delivered but USPS tracking says it was) and ask him/her if...

 

a) The Postmaster can speak to the recipient's mail carrier to see if he remembers the package and/or where it was left?

b) Could the Postmaster please check their GPS records and verify where the package was delivered?

c) Could the Postmaster help you in any way track the package through ths USPS system?  (USPS takes automated photos of packages as they go through their system now.  The more proof you have that the package was indeed mailed/in trsnsit and delivered, the better.  The local Postmaster may not be able to initiate the photo/scan search for you, but I believe there is a place on the USPS website or via their 800# where it can be requested.)

This changes things a bit. You didn't mention that he has already filed a Not As Described dispute (not an Item Not Received dispute). You could respond with Return for Refund (do not select Refund Only) and see what he does next. You do have to respond in some way before your response deadline today, or else the buyer will win by default.

 

Others will have to fill in the details here, but I think you could send him a return label that would have to be used within 5 days, or else he'd lose that dispute. Not sure what he would send back, of course.

Huh?   I'm confused now, @rowtid.

 

What's gone on here?   First you said the buyer claimed he didn't receive the item even though USPS says it was delivered.   Now, you're saying the buyer has opened a Return Request with the reason being the item was damaged?  So, is he now saying that HE DID receive the item or what?

What does this mean?  What doesn't give you the option to open a claim with whom?   What is still being sent?    What is it that was supposed to have arrived in your email and isn't there?

Those are the buyer's own comments that were pasted in by the OP from the dispute console. Note the "Info from the buyer" heading just above it. 

 

What's most concerning here is that the OP's response deadline on this case is April 9th... today. If the OP doesn't respond in some way they will lose everything by default.

If he filed a SNAD, then he can't file an INR, because obviously you have to receive something before you can say it's not as described.

His claim was for Item damaged

but in his messages he is claiming he did not recieve the item 

 

This is what he wrote to me when he filed the initail claim:
