"...hi...i dont have proof of him receiving it,,,just proof that it was on its way,,.."

 

what is the "proof" that it was on it's way?

As others have herein reminded you, the proof that eBay requires is tracking showing the item was delivered.  Proof of mailing means nothing basically.

You are not responsible; the post office is. Refund your buyer and let the post office know they lost your package. Assuming you insured the package, the post office will refund you for their mistake.

Because that is the law. People always think that is an "ebay thing", it is not. It is actual law and has been for decades.

I know it is frustrating ( I have had it happen to me also) but put yourself in a buyers shoes. You go online, buy something and it never arrives. Would you not expect to get your money back?

I know it's frustrating, but it is the policy on eBay that until the package shows delivered to the buyer's address, it is the responsibility of the seller to make sure the buyer is made whole, either through the delivery of the item or a refund.

 

You still have some options. File a missing mail request with USPS. you should have an option to direct what address to deliver the lost item. Or you can file a package intercept with USPS, which will return the package to you. I believe there is a approximately $15 charge if USPS successfully intercepts it and returns it to you.

 

If you insured the package when you printed the label, you can also file a insurance claim for the lost package and if USPS cannot find it, you should get paid from USPS. This assumes that you paid for insurance. If you shipped priority mail, you should have $50 of insurance regardless of whether you paid for additional insurance or not.  If it was shipped first class or parcel select and you didn't check the additional insurance box, you're going to be out of luck on insurance.

" It is possible that a porch pirate took the package and the buyer thinks that you didn't send it out."

 

 

Even if a porch pirate eventually took the pkg, it would still show as delivered with tracking.

This is called the cost of doing business. Every once in awhile USPS might lose your package and you always have to refund the buyer if that's the case.  If it was a priority package or you chose to insure it then you can file a claim.

Since 1978 (44 years) I have been ripped off 4 times.  Three times  I am the one who did not receive what I paid for.  It is something that rarely happens and someone can go years and years and never get ripped off or have a package lost.

If tracking shows it hasn't been delivered, then that's that. If the item is worth it, can pay the (I think) $15 to have it redirected back to you.

 

If it's been a lot of time, you can do a missing package request with USPS and maybe it'll start moving again. If it ever does show up, you can try getting the buyer to send the money to you via PayPal. Another option I believe you are able to do is appeal eBay for Business via Facebook and they may give you the money back on it. But I don't know if they're still doing that. But they might be willing to give you a freebie.

If you shipped something and did not have tracking uploaded to the sold file you are at risk for losing an Item not received claim. 

 

Delivery is part of the transaction ... if that does not occur the Buyer has the right to file a claim for a refund.  The Seller has to take the undelivered package issue up with the carrier.

 

If you shipped to an area affected by the winter storms OR tried to ship OUT of an affected area eBay will protect you on your Seller metrics AND extend the delivery window to adjust for late shipments.  If that did not happen then you are at the mercy of the carrier.

     Still not a lot of detail regarding the item so I am assuming there is more to this story. No clue how you shipped the package but USPS has insurance coverage on priority mail. Following is the timeline to file a claim with USPS for a lost package. time.jpg

Because, as a seller on eBay, you are responsible for the item being delivered to its buyer.
Am I, like, the sixth or seventh person to give this answer in slightly different wording?  

My selling ID sent a package from Southern California to a buyer in Massachusetts on Friday, December 23, 2022.  The box did have a tracking number.  And the USPS duly tracked it every day until January 1, when all activity just plain stopped. 

I filed a package inquiry with the USPS and their response, after three days, was essentially, "Yeah, we don't know where it is either. If it is not delivered to the addressee in two more weeks it is deemed to be lost and your only recourse would be to file a claim for any postal insurance you might have purchased for it."   But I hadn't purchased any insurance for it.   The total sale was under $25.00.  I trusted the USPS, as did the buyer.  And I voluntarily refunded the buyer completely.     

Any kind of retail business that uses the postal service or FedEx or UPS or, in the olden days, the Wells Fargo wagons, for delivery must accept the risk of loss of the product in the mail.  When you sell on eBay, you take that risk, the same way that QVC does when they send you a Denim & Co. sweater you bought.  Accidents happen.  Weather happens.  Stuff can always happen.
