It's appalling the lengths some will go to. I'm very sorry you are going through this. There should be a spirit of fair competition, based on actual merits of each item.
That said, a fixed price listing might be better protection in any case.
You might want to come up with something non confrontational addressing the virtues of your clock.
Good luck.

I have seen what you mentioned before. I have even seen some sellers name the other seller in the description. Is there a rule against it? I don`t know but IMO it`s an unethical practice.

Well, he is saying your description is fake and that you copied his 1st listing, not the clock.
After looking at both, the descriptions are very similar.
Yours

If you copied his listing description, that could be why he has posted that explanation.
Change your description. If you copied his description, apologizing might cause him to remove the unflattering references to your listing.

Well, forget about the apologizing. Too late now. You both have bids; he has more bids than you do.

I retract this post.

"The other seller has a big warning at the beginning of his description that the other seller (me) has a fake description in the listing claiming it was copied from him. Thus, leading people to believe I have a fake listing. This behavior is completely against Ebay's Policy. His statements are completely false and my listing has nothing to do with the sellers listing. "
Disregarding who is the mother or that baby "description", the law or any rule doesn't entitle an alleged victim or attacker, criminal, etc. to go against such figures. And the judge (Ebay) should be an active participant in the litigation but "only" to clarify the provenance of such description, not to support the party that is violating Ebay's own rules.
If they play that role, eventually everybody will be entitled to berate, diminish the integrity of any other seller "because there's an almost similar wording" on their competitor's description. The description should be disputed, and the "accusation" should be withdrawn. They need to follow their own rules.

the only thing similar about are listing is that we are selling the same thing! My title, condition, and description are all different.

OP, if you read message number 4 in this thread, your description does seem quite similar to the seller's original description. I wouldn't say for sure you copied because I don't know, but if I had to guess it would look like you did based on what I read.

You have done all you can do. EBay took your report and will take actions if the backside investigation warrants it. If eBay is not taking any action that should tell you they have not found reason to. They will not tell you what they find or did not find.
Quit worrying about the other sellers actions and begin to present your item with outstanding info, pictures, descriptions. You will stand out in the end.
Also I do not understand how you can know the other listing has more watchers than your listing does. Buyers do not have access to sellers active listing info.
Not many things seem to be adding up in this thread.
Good Luck Selling!

His listing is ending before yours.

Realistically there are no policies except for "ebay gets to give your money away when they feel like it"
Almost every policy is contradicted by another policy and then overruled by a secret policy.
This is the internet version of the movie Brazil.
