eBay fraud

Good day everyone. I am selling digital CAD plans of an advanced router. A buyer bought an item, received it then opened a case claiming that the usb dongle with CAD project was not what he expected and that the item was different from the description. He didn’t go further into details and eBay happily refunded the buyer despite the fact that I did fulfil my obligations as a seller in full and provided a mail receipt that the item has been sent to the buyer. A previous discussion with an eBay representative confirmed that the buyer simply wanted a free gift at my expense.

This is not the first time eBay harasses me with complete neglect for seller protection, I need help how to deal with this type of fraudulent behaviour from this company.

If you don't have tracking to prove delivery eBay will side with the buyer every time.

Mail receipts will not work.

Yes, I know, but OP says he/she has a mail receipt and that will not work. 

Yes, the buyer is probably trying to rip off this seller and they succeeded due to no proof of delivery.

Thank you for your prompt reply. I have the receipt and the tracking number on it, the photo of this document has been sent to eBay support right after the case for a complete refund has been initiated by the buyer who indicated that he wants the refund after the item has been sent to him in our chat. Then he received it and occused me of providing an item that was different from the product description. 

So, eBay staff confirmed that the buyer is simply looking to get the product without paying and it was confirmed by the eBays support member in writing prior to the refund case. I just don’t get it how eBay claims to protect the sellers and rips them off. I will not continue selling on this platform if the case is neglected, I am really fed up with this type of discrimation, fraudulent behaviour of buyers and consequitive fraud by eBay to make fraudsters happy.

Here is the problem.

From your listing: 

We will send you this package as a download link after you purchase the plans.
 
This was a digitally delivered item and it was listed in the wrong category. Your listing shows a picture of an item that is not actually the item.
 
eBay found in favor of the buyer because this listing didn't comply with listing policy and you didn't actually send an item.
 
You really need to read the rules on those items:

Hello, Did you buyer open a "Significantly not as described case"? 

 

The core issue may not be the delivery and receipt of the item - your buyer seems to be saying the item differed from the eBay listing description. This may be true and it may be false - but in either case as the seller you should have approved a refund, issued return postage and gotten your item back in your hands for future resale. 

 

It's best to come here when a case is opened to get some assistance as sometimes eBay customer service representatives with good intentions will offer sympathetic words but miss the big picture. And the big picture is that eBay rules favor buyers and the goal is not to be right or sometimes even win as case - and that is difficult but to get your item back in your hands - not to gift the buyer with the item AND a refund. That scenario will play out if you as the seller don't act quickly to figure what type of case was opened. In this case, a SNAD case means the seller is on the hook for the full return (there are exceptions if you offer free shipping & free returns).   

 

In your case, did the buyer get the refund and the item you sent? I am hoping not.................I understand how frustrating this can be.........

And.......as sunnysouth observed, digitally delivered items are a whole different issue. I thought that the item sold was a dongle etc. actual equipment.

He did get the product and the refund, thank you for participating. There are delivery companies in Russia who provide fair service of “Protected merchandise”, - when a buyer receives the product, he can either take it away in front of the customer service of the delivery company or opt for not getting the item, then the product is returned to the seller intact, no fees for return delivery. eBay has no instrument of verifying who is right and who is just like Sunny and the buyer I am talking about. Instead, they harass sellers every time a fraudster buyer shows up. Sunny, why would eBay allow me to sell twelve products to twelve happy customers before and in a different category? Smart you.

You haven't read any policies for selling here. Your comments show this.

Did you read the link I gave? You MUST  list digital items in the correct category.

Listings can be reported to eBay when they violate the listing policy. Your listing has either been reported and eBay hasn't removed it yet or it wasn't reported yet.

 

You really need to read about selling here before you find yourself in trouble.

If you keep up with the rude comments you may lose your ability to post on the eBay boards.

The issue is not one of receipt.....the issue is that the buyer claims they did not get what they ordered ie: SNAD.  If you had approved the return and paid for return shipping you would have rec'd the item back.  But, it appears you are not here for a resolution or ideas to resolve your issue or avoid a similar problem in the future.

 

Your response speaks volumes - I would suggest you read up on eBay's seller and buyer protection policies as well as the digital goods policy.  I get that you are frustrated, but how you responded to this case lead directly to the outcome you recieved. 

 

It's always better to play nice in the sandbox.

Wow, glad you reported this - you were trying to help and you made a very important point. It's sad when people react with rudeness to the person who is trying to help them navigate their issue.  The good thing is most people here appreciate the help you offer - this rude reaction is pretty rare.

Yes, there are many rude OP's. I don't normally post on these boards but we get rude OPs on the M2M board too.

 

It seems that some just do not want to hear anything other than what they want to hear.

Are you saying that you actually shipped a USB dongle to the buyer? If so, why does your listing state that the plans will be delivered by email? 

 

Are you charging shipping, purchasing a tracking number to "prove" you shipped, then delivering the plans by email?
