eBay does not protect sellers at all and buyers are shady

 

Hello - I have a fraudulent claim opened by a buyer against me because the buyer "changed their mind" (they didn't read the post) 2-weeks after purchase and did want to pick-up there item (I am local pick-up only)
 
Timeline:
  • I, seller, posted a product for sale - this product is for local pick-up only and it clearly states in several areas what the product being sold is -- including the size (california, cal-king)
  • Buyer made an offer and I accepted it
  • I then tried for two weeks to coordinate local pick-up
  • Finally the buyer responds, but the realized that they did not read the listing and that it is the wrong size for their need <-- that is an error on their end
  • But as clearly stated in my profile - I don't accept returns and the item was listed as local pick-up only, I had tried to coordinate a date/time and provided my phone number and location
  • Then the buyer fraudulently open a case against me for non-delivery - but 1) the item was for local pick-up only 2) even if i were to deliver it, I don't have the users address to do so -- making it impossible for me to deliver <-- this is fraudulent reporting and behavior
I feel like I fall under the eBay seller protection, given that: 1. I did not do what the buyer accused, 2. I have taken all actions to get the person to pick-up their product, 3. This isn't Amazon, because a buyer should not be able to change their mind post-purchase...especially 2-weeks after the fact for a local pick-up only situation, because they did not read the description clearly, and 4. it clearly states I do not accept returns (I am not a retailer)

The buyer should be obligated to pick-up their purchase, and if they want to sell it themselves because they did not read the description closely, they can do so. But I should not be required to refund them in any sense because I did not violate any kind of policy - and I have met all of the eligibility for protection given that my listing was accurate and their claim was false (given that my item is pick-up only), and their false claim that I did not have the size listed in my description - the old post is still accessible, its in the headline, description, and in the compatible sizing field. 
 
At this point, I want to pursue legal actions against eBay and/or the buyer to be honest, for not obligating their own policies and purchases. Who can I get to help? I am soo frustrated.

If paid, I would just refund, be done with it, and move along.

 

Is everything that is shown in the main photo (1st photo) included?

 

If not, it should not be shown. All that some look at is the 1st photo.

 

ETA: not saying the buyer is in the right, just that some battles are not worth the reward.

Wait...the buyer paid, you still have the item, and you want to sue the buyer? That's brazen.

Unfortunately, even a more stringent policy than Ebay enforces on no returns would not make up for the fact that you have inconsistent information on your listing. A mattress is pictured and you claim the mattress is not included in the sale on your description.

 

When your listing is inconsistent and you appear to offer more than what you say in words, the sale is not final and the buyer is entitled to a refund, if you have the merchandise.

 

You cannot get away with sloppy work.

Take it from me. I have been selling on here for over a decade. You are going to get buyers who may have made a mistake purchasing your item. They change their mind, they decide they do not want it and YOU WILL refund their purchase on here and if you do not THEY will pursue the situation WITH ebay and THEY will refund them. If you refuse to work with these buyers and ebay has to step in you will get a DEFECT ON YOUR ACCOUNT FOR THAT TRANSACTION. BUYER ALWAYS have the upper hand on this website as far as getting their needs met. We have heard the sue Ebay story so many times on here it’s just moot. That will go nowhere whatsoever. No grounds for that at all. Take care of this customer and means refund them.

So far, it seems like a positive. Especially since returns and refunds are a part of doing business here on eBay.

@dryophelia thank you - unfortunately, they are like "you should refund the buyer because they do not have the product" and because they are making false claims that it wasn't delivered (because its local pick-up only and they are refusing to pick it up), and that the dimensions weren't listed (which they are, they just didn't read). 😞

@buyselljack2016 the buyer is not complaining about the mattress , they have a king size mattress and the bedframe that they purchased is a cal-king. so they realized that the frame was incompatible to their mattress, which is why they are trying to get a refund. honestly, had they realized their mistake on day 1 or 2, this wouldn't be an issue, but they didn't realize it until day 14

@doc-holmes I just want them to come pick it up and deal with it, like anyone else would. It's like buying something on clearance at a retail store that is non-refundable. If it doesn't fit, you're still obligated to take care of it yourself...like reselling it on ebay or poshmark or facebook marketplace.

@tobaccocardyahoo the buyer is not complaining about the mattress , they have a king size mattress and the bedframe that they purchased is a cal-king. so they realized that the frame was incompatible to their mattress, which is why they are trying to get a refund. honestly, had they realized their mistake on day 1 or 2, this wouldn't be an issue, but they didn't realize it until day 14 and then made the false claims that it wasn't delivered (when its local pick-up and I tried to coordinate with them for several weeks) 😞

@vintagecraze50 that is insane to me, so if one person breaks all the rules and the other person follows them, it doesn't matter. plus, after this experience - i don't think i will ever sell on ebay again on facebook, rather risk facebook marketplace or something, hell, i'd take craigslist

Thats probably for the best, Ebay isnt for everyone.
