Ahh an email reply from eBay...
"
I appreciate your willingness in sorting this out with the buyer. This only goes to show that you are a responsible seller and you are an asset to the eBay community.
We trust that you posted the item as described and in good condition. We also have a record of the buyer stating that they no longer need the item however since there is a discrepancy on the information provided by the buyer, we have concluded that the best course of action is for the buyer to send the item back for you to inspect it.
As part of your seller protection, if you received the item and it is not on the same condition as it was, you can contact us immediately for further investigation. Rest assured that we have protection in place for you."
Such **bleep**. The item will be returned in perfect condition I am sure of it. So I get the shaft and he got to rent my item for two weeks.

I copied this from the help pages regarding returning an item:
"If the item you received arrived damaged, doesn't match the listing description, or if it's the wrong item, you're covered under the eBay Money Back Guarantee. You can return it even if the seller's returns policy says they don't accept returns."
Well. It appears the buyer knew how to utilize the MBG. Unfortunately, you will need to provide a shipping label for the return and then refund or just refund with no return.
I am sorry this happened to you. It is never pleasant to lose a sale no matter what the reason.
Good luck.

This appears to be your first Money Back Guarantee case? You have had a good run with very few issues apparently, so I wouldn't let one get you down.
It is important to be aware of the terms of the MBG in particular, because choosing the right course of action is imperative. I'm afraid the course you took has penalties. Because you initially failed to accept the return, you will now be charged the Final Value fees and your account gets a defect. The MBG terms trump a seller's terms, so a No Returns position doesn't count when a case is opened. This may not seem fair, but it is the way it works and one of the risks of selling here. It is all outlined in the policy and the User Agreement. It is not in a seller's best interests to ask eBay to step in on a Not As Described claim. Even if the buyer is lying, they will prevail. It is automatic. The point where a human examines the case is at the appeal level.
If you feel you have a strong case, your next move is to appeal the decision. Below are the Help pages instructions on how to go about it. Good luck, and I hope you receive satisfaction for your issue.

eBay allowing fraud now?
Fraud has been an issue on eBay for over a decade now, since eBay introduced the Money Back Guarantee in 2008.
If it reaches an unacceptable level for a seller, the seller leaves. Observation indicates to me that the number of sellers leaving is not a concern for eBay.

Unfortunately, some good sellers leave and new ones take their place. Then once their eyes are opened some leave and the cycle continues.

That is just how it works on eBay for quite a while now. It is unfortunate for sellers, but eBay caters to buyers and want to keep them happy. Just hope they return your game in good condition so you can resell and get part of your money back.
This and good til cancelled caused me to close my buying account here. Hopefully this won't happen to you very often.

Sep. 11 :A return request initiatedSep. 11 :Case openedCommentsThe buyer has stated twice that the item he purchased works fine he just doesn t want it anymore after buying it. He initially falsely stated that the item was defective. He has not responded to my request to close this case. I need eBay to step in and cancel this return request. Thank YouSep. 6 :You sent a messageCommentsUnfortunately returns are not allowed as shown in the original auction as I do not accept them. Please cancel the return request. ThanksSep. 6 :The buyer sent you a messageCommentsI was able to use it but I no longer need it.Sep. 6 :You sent a messageCommentsWe’re you able to use it and no longer need it or did you change your mind about wanting to keep it?Sep. 6 :The buyer sent you a messageCommentsI know no longer need the action replay.Sep. 5 :You sent a messageCommentsWhat exactly is the issue? ThanksSep. 5 :The buyer requested a returnCommentsAction Replay does not work with Pokemon games on my DSBuyer lied about the item being defective, admits it twice and ebay still allows the return. So we can just rent video games from people now? For free? This is exactly why I only have 2 items listed for sale right now instead of my usual 25+. eBay has screwed over the seller time and time again and so I moved all my goods to other platforms and have had no issues selling.
Ebay has allowed and condoned fraud since day 1

If it gets returned and is perfect working condition, I will sell it on another platform. eBay will not be getting any more of my money. Even when the buyer openly admits they are lying, ebay sides with them. Unbelievable.

Willingness??????? Are they crazy??? I would rather them say they realize you got the shaft but thats what you signed up for
09-11-2020 11:21 AM
Hmmmmm, that would really be disconcerting - ebay saying it with a smile on their face. Scary!

What I still don't understand is why do sellers have to follow
ebay policies? It's our business, and ebay doesn't even follow
the rules of it's own policies. If it at least was consistent, but
they are not consistent, other than consistantly siding with scammers.

why do sellers have to follow
ebay policies
The party that controls venue AND the money, dictates the policy and the outcome.

Buyer lied about the item being defective, admits it twice and ebay still allows the return. So we can just rent......
That is how it works now. What the buyer says in any communication does not matter. What is in your description and TOS will never be considered. ALL THAT MATTERS IS WHAT THE BUYER CHOOSES FROM THE DROPDOWN MENU WHEN MAKING A CLAIM.
They don't have to "rent"...LOL. this is the easiest place to get it for free.
I sold here for 20+ years and had only one faulty return until this policy changed. Then then the "liar buyer" just became too commonplace, and funding returns for same did not fit my business model. I took my purse and wallet and left the building.
