cancellation of a transaction by mistake the item has been shipped and the buyer has received it

by mistake, I have refund buyer, but item received after refund.

I have sent a lot of emails to the buyer but not respond.

I have sent a new invoice but no luck.

I cant open unpaid item case because transaction cancelled by me.

I informed the buyer that the item was shipped and replied that it was not his problem and eventually received it. I sent a return label paid by me but ignored me. Now he says that what he has is a gift!
What can I do?

Where is seller protection?

You gave the buyer back their money, and sent them an item.

No one can protect you from making mistakes except you.

Here in the states, we can recall packages while they are in the mail stream.

Not sure how it works where you are.

If he has the item, and his money back, you have no options.

No way to recover it......Ebay can't arbitrarily charge a customer without their permission......  not a case of no seller protection, rather a case of you making a mistake and having to live with it.
