ALL eBay buyers have the protection of eBay's Money Back Guarantee. It's a really good idea for sellers also to read this and understand it.
If/when that buyer opens an item not as described case, you, the seller, will be required to send him a prepaid return label and refund him in total when you receive the item back.
You cannot decline. And eBay will not "step in " on your behalf.

Sorry but it is your fault. You cannot sell something that does not work. What you do is get the item back and then make your claim to the company you say made the game.

Accept the return, send a shipping label and refund once you have the item in your hand.
Do Not wait or ask eBay to step in… you will loose all FVFs, you will loose the item AND eBay will refund the buyer.

Its the company who made the game it freezes sometimes not all the time. it is playable. Everyone who plays the game on xbox , playstation or even on a computer knows that. It does work. So its not my fault.

EBAY Money Back Guarantee (supersedes "no returns" policy) protects customers if item is "defective, damaged, counterfeit" (you are forced to give full refund) plus shipping BOTH ways.
If you don't accept return EBAY will do it "for you" (give customer full refund) and tell customer to keep item. EBAY will also give you a defect on your account for not obeying the rules.

It may not be your fault, but it is your responsibility.
If you don't want it back, you can refuse the return.
But you will still be refunding.
So, allowing the buyer to be right about the problem, do you want to have the thing back, refund him, and pursue the manufacturer if it is still under warranty?
Or do you want to save the cost of return shipping, let him destroy the thing, and refund him?

I recommend accepting the return and sending a return shipping label.

Obviously, everyone does not know that. Like I said return your item to the company where you bought it and get a refund.

best buy, gamestop or any video game store would not accept a return because the game freezes its not their fault. So i should not be penalized or should accept a return either

Totally irrelevant. Accept the return and send return label.

If you know the game tends to freeze, I would not have sold it to begin with or you're going to run into stuff like this. As above, you bear responsibility for selling a defective item.

Best buy its where i bought. They will not accept a return because it freezes occationally. Its not their fault ofcourse they will not accept it. All games have freezing and frame issues even halo just came out call of duty just came out . They all have issues you think we will get refund because of that NO. So the buyer is wrong like always.

You don't have to accept the return, but you'll be refunding.
You can let Ebay decide the case and they'll refund the buyer from your account and let the buyer keep the game, plus give you a defect for not handling the return and keep your fee's.
