another seller copying my work

Another seller is copying my work and listing it on ebay

They're listing copies, photos and written descriptions verbatim from my listings.

This is not only harmful to my business but ebays as well.

I have been a seller on ebay for over 25 years and this is the first time anything like this has happened.

Not only is it unethical but allowing this to continue can only tarnish ebays reputation for honest business practices.

Can you point me in the direction that I need to go to pursue the best manner to correct this.

Can you provide an example?

 

Generally speaking listing Titles and Description text is not protected if no trademarked names are used.

Ebay doesn't take misuse of intellectual property seriously so they don't act on reports when your ebay listings are copied by another seller. 

 

However a workaround (and one I've used with success many times) is to file NOCI (VeRO notice of claimed infringement) with evidence that your work was used without your permission after being found on another site. 

 

On the NOCI form, you'd include the infringing listing and evidence of the link to the outside work where your pictures and/or description was found.

are they listing them at higher prices? If so maybe they plan to sell then buy from you to redirect to their buyer, againts TOS if that is the case.

Do you mean that they are copying your descriptions and photos from your listed items?  I had that done to me many times.  You can write to the person to stop doing that but they might not.  Reporting it to ebay is a waste of time because itself is taking seller's photos and using them too.

Put your title/name in the picture someplace. That may stop the photo use but the words are up for grabs.

 No big deal, I mean I would not care.

You could watermark your photos with your ebay name across the photos to stop image thieves. Also listing in html might stop them from copying your listing details.

Do you own the intellectual property (ex. a design patent) for the tool?

What should I do if my image, video or text is being used by another seller?

When you create listings you give eBay and its customers permission, through our user agreement, to use your images, videos and product details. Your content may be added to the eBay product catalog, and may be used by other sellers in their eBay listings.

You may contact the seller and ask them to remove your image or text if it is not part of the eBay product catalog.

I think someone has copied my eBay listing but made theirs less expensive. Can this be done? Everything down to my account name, and items has been duplicated but the item at a lower price. What can I do? Has this happened to anyone? Thank you.

This is a very old thread from January of 2023.  I doubt the person who started it or most here will reply.

 

Should you have any issues or problems, it's always a good idea to open your own thread.  That way you can get the help and advice you need for your specific issue.  When you piggy back on someone else's thread, most times your questions or concerns will go unread and get lost.  Start your own thread.  Best idea.
