I received an email today that my listing for a bottle of cologne was removed because it didn't meet the cosmetics policy. This is the policy listed in the email:
Listings for used cosmetics, sponges, or applicators are not allowed. This includes products such as skin moisturizers, sunscreens, perfumes, lipsticks, fingernail polishes, eye and facial makeup preparations, shampoos, permanent waves, hair colors, toothpastes, and deodorants.
- Used cosmetic brushes can be sold but must be thoroughly cleaned
- Cosmetics, colognes, perfumes, and lotions must come in the original container
- Homemade cosmetics must comply with government regulations
My bottle of cologne is in the original container so as far as I can see it meets the policy. I see dozens, if not hundreds, of partially used cologne and perfume bottles for sale still, even partial bottles of the same exact discontinued cologne I listed. If I re-listed this cologne and stated that it is still in the original container would it be taken down again? What options do I have here? I don't see how my listing did not meet the policy. It isn't in the original box but is still in the original bottle.

I went to that link and the text that is accompanied to the post says:
Griff: Some of the examples in my I collection are really, really old. Like they're from the fifties, forties, even the thirties and some are bottles that are half full from either evaporation or maybe they've been used. Those I cannot list in health and beauty for fragrances categories because they would be considered used. And that category for condition was edited out last year to exclude any used condition.
If Health & Beauty was where OP listed the perfume then that is why it was taken down. Griff goes on to say that if the perfume was vintage it can be listed in another category:
Griff: Well, it has something to do with the FDA regulations on used cosmetics. You're not supposed to sell them. And unfortunately this makes me furious is that perfumes are considered in there. So eBay was proactive, making sure that they weren't violating FDA guidelines. And so they eliminated the used category from the Health and Beauty fragrances, but there's another category that you can list these in. In collectibles, it's called Vanity Perfume & Shaving Collectibles. That would mean another listing template for that category.
Don't know if the last statement is correct or not if any changes to policy/category guidelines have occurred.

Is it partially filled because it has been evaporated, or because it was used?

I would not relist it. You already raised one flag and more could get your account banned. I know it doesn't seem fair, but no need risking your ability to sell here.

The portion missing was used. The policy only states that colognes need be in their original container. There are hundreds of other partially used bottles up for sale with no issues.

That list is not an either or. Used perfumes are not allowed AND all perfumes must be in their original container, even if they have never been used.
Yours was reported and pulled because it violated policy.

You highlighted (in bold) the part you think applies. I highlighted (in red) the part that does apply and added, in red italics, clarification of the policy.
You risk have your accounrt suspended permanently if you re-list. now that you are on the bots' radar. It's not worth it.
As for other listings that don't follow policy, you can always find them. Sooner or later, the eBay bots find them, too.

That one was listed as "new" without box...........

This is e-Bay's platform. It does not matter that you do not understand their decision nor why other sellers are not being so penalized with removal. Your options are to re-list and risk a suspension or to accept the removal and concentrate on being successful.

Selling used perfumes is OK on the platform..........Griff has sold/still does sell them.........but they have to be listed in the right category....

There are hundreds of people that speed everyday and don't get caught. Take the bottle of cologne and donate it or toss it. Spray it on your garbage cans to keep rodents away. If you list it, Ebay will shut it down again and suspend you. If we were neighbors, I would ask you for that bottle of cologne. I have a very bad case of raccoons eating through my plastic garbage cans to get the trash. I don't have any cologne in the house.

Are you sure Griff is aware that there have been a few policy changes since he started working for eBay? I haven't listened to him for many many many years but when I did he often demonstrated that he was not all that sharp or up to date with things.........Still a nice guy.....BUT!
