Buyer recieved the item. Tracking and his emails prove it. Then he told ebay they didn't. So ebay sent him his money back. He won't return the item. Many back and forth with ebay but no resolution for months. They admitted he received it and got his money back yet ............................crickets. I've talked to police and will use the law if necessary but this is really on ebay and they should act on it.
Is ebay using AI for resolution or do actual humans look it the issues? WHO did I call to fix this?

Ebay has strong Seller Protection on items not received. It appears what happened to you was because you were away on Vaca and didn't know you have an issue needing to be resolved. So you likely were not able to respond to the INR within the timeframe and it closed in the buyer's favor.
I would suggest you contact Ebay again and go over what happened. You should have been covered even though you didn't respond to the INR if the tracking showed delivered. I know you said you have contacted Ebay before, but this is obviously going to take at least another try.
I would suggest that you contact Ebay for Business on Facebook, Instagram or Twitter for the better trained CSRs.

Not all options are available 24/7. It will depend on staffing available. So sometimes you can request a call back and sometimes you can't. Sometimes you have the Chat option available and other times it won't me. If it is important to you to use one of those options, just try back later.
If you use a cell phone or other mobile device, you may need to turn off your Spam filter so that Ebay can call you.
If you are a seller outside of the US or Canada, you will need to use the Chat Option.

Most of the time the package was delivered to a neighbors house by mistake. However, there have been a couple of times I've knocked on a door supposedly where the package was delivered and they said they didn't receive it.

While that can be true, for the Seller Protection on Ebay it is what is required to be covered. As long as the seller ships within their stated handling time, uploads tracking and the tracking shows delivered, they are covered under Seller protection. Oh and if the transaction was for $750+ signature upon delivery is required.

THE ONLY WAY ebay would not honor an INR case is if you failed to respond to the INR message initially from the buyer. Ebay has tracking info showing whether items are delivered but they always ask you to respond to this case and YOU MUST do that every single time. The auto system goes into favor the buyer mode if you do not upload the tracking into the INR email you get. As a few have posted here, if you got an item not described case those go into favor the buyer mode on the auto system. You must act quickly and respond return for refund and to save more hassles send them a free return shipping label to get your item back.

Below is the response I received from ebay months ago and NOTHING has happened. He still has my item and his money back. I've asked him to send me the item back but nothing has happened. I will take legal action. It's not about money it's being defrauded. I've talked to police and my lawyer already.

If this issue happened "months ago" it is likely too old to get any real action on it. When was the transaction? What was the date of this email from Ebay?

Ebay finally sent me the funds. The buyer CLEARLY LIED and should be banned.

If that's what happened, you did something wrong.
1) Buyer files a INR (item not received) case.
2) Seller responds to the case with tracking number that shows the item was delivered.
3) Ebay finds in favor of the seller. No refund to the buyer. Case closed.
