When a buyer isn't required to return an item
In some instances, we may not require that an item be returned to the seller. In these situations, we refund the buyer and may seek reimbursement from the seller, for example if:
- The return request was opened because the item was not as described

At this point in the eBay Money Back Guarantee policy, eBay was asked to step in. So the window of opportunity to be proactive has closed.
Now that eBay has stepped in, eBay goes down the list of instances:
1. The seller chooses not to accept a return request when they offered returns in the listing
2. The return request was opened because the item was not as described
3. The seller did not provide a return shipping label or funds for the buyer to return the item
4. The item location was misrepresented
5. It's hazardous to ship back the item
6. The item no longer has a value (for instance, a ticket for a cancelled event)
Very quickly, eBay breaks away from the list at #2:
The return request was opened because the item was not as described
and issues a refund, no return required:
In some instances [e.g. #2], we may not require that an item be returned to the seller. In these situations, we refund the buyer
So the policy allows,
- if the seller is not proactive to resolve the request themselves,
- if eBay is asked to step in, #2 is why eBay forces a refund from the seller
- without requiring a return, and
- without any further action by the seller.

Even if what you pointed out was the case, which it's not (as everyone has pointed out). Isn't ebay allowed to implement rules, no matter how ridiculous we think they are? We're not forced to agree to them and sell here.

Nothing has changed in recent times. As a seller, we control the return process. To have the item returned or not returned before refunding is a choice.
No doom, no gloom.
