Hi. I was reported for Vero violation but the thing is the picture is not even the same. They take listings down and restrict your account for 3 days. You can file an appeal but companies don't even respond or refer you to another dept within who handles this. You submit them the details which takes around 2-3 days making the lifting of restrictions pointless. As you go through this channels your 3 day restriction stands and you're losing money. How is this in any way fair when I am NOT at fault. From what I know brand names hire people in other countries who hire people to look for brand pictures. I have attached both pics (2nd pic is mine) and clearly my band length is different and also the second hand is near 6 o'clock mark where brand has the hand at 7 o'clock mark. My quality is also not as great as their brand. Not to mention, these violations stay on your account. This is unacceptable. Anyone can suggest something here.

@the_watch_carnival, you didn't get a VeRO vioaltion because you were using the brand's pictures.
You got a VeRO violation because you were selling fake Diesel watches, which you have now admitted to doing. You can't sell counterfeits or fakes on eBay, or anywhere. It's against the law.

What are you talking about? Where did I mention I am selling fake watches. I only sell genuine watches, not fakes. My reviews also indicate that. Please don't accuse someone of something you have no knowledge about. The quality I am talking about is of the picture NOT the product itself because when you take picture it will never be same quality as manufacturer because their pics are made on computer and NOT an actual traditional picture of a product but a graphic. So my product is not fake, my picture quality that I took in a light box is what I was referring to.

If in fact your items are knock offs you got exactly what you deserved. Surprised you were not caught earlier.
06-26-2021 09:13 AM
They're not knock offs, they're original with box and tags. Why are you people so confused about my posting.
06-26-2021 09:15 AM
I apologize on my part for wording my post wrong. When I was referring to my quality not being as good as theirs, I didn't mean the quality of the item itself. I was talking about the quality of the picture that I took in a light box. All my items are 100% real, not fakes. They all come with box, tags, and paperwork.

VERO means that certain companies do not allow unauthorized individuals to sell their items on the secondary market. If found, they will report you. Appears Diesel is one of those. You need to do some research.

If I understand, are you saying your listing was taken down because of a photo?
Is that what the ebay message said?
Here is the link for vero info>
Here is the link for removed listings>
Here is the link to authenticate watches, etc>

I understood what you mean the 1st time I read it
the stock picture on amazon and the manufacturers websites are outstanding and just perfect
the pictures are better than I coud ever take
proof that its your is the different position of the sweep hand and length of strap
if you are borrowing descriptons from the web that coud be it.maybe not the pictures .
if I were you I might ask some grey market sellers how they can list so much product
there are many wholesalers in New York that I trust.they sell on ebay and have been doing it for years
I am unsure why your stuff is causing a problem with vero
good luck

But are you an authorized dealer for these watches? Maybe Diesel doesn't allow just anyone to sell their watches as "brand new," as though you are a dealer in their waches. That's what you need to check. I don't think the violation is over the photos.

That applies if somebody is doing large quantity sales of new items as an unlicensed retailer.
First sale doctrine allows sales of used items or items that we have personally purchased.
https://www.businessjustice.com/first-sale-doctrine-in-trademark-and-copyright-law.html
The first sale doctrine allows the resale of products that constitute or contain someone else’s intellectual property without the owner’s permission, as long as the person lawfully owns the product. The first sale doctrine is codified in U.S. copyright law, and court decisions have applied it to trademarks. It can serve as a defense to a copyright or trademark infringement lawsuit in certain situations.

Yes, it was taken down because of the photo. They're saying I stole their photo which I clearly didn't. As mine and their photo is completely different. You can even tell by the quality of my picture which isn't as vibrant as their because I take my pics with a phone.
06-26-2021 09:33 AM
The reason is because they're saying I took their photos which isn't true. You're allowed to sell Diesel and other branded products on eBay. You don't have to be authorized but everything I do sell is authentic. I have been for years and nothing but happy customers from around the world.
06-26-2021 09:34 AM
You don't have to be an authorized dealer. You're allowed to sell on eBay. Their problem with me is they're saying I took their pictures and used it in my listing which I didn't. Meanwhile, I am losing money because I have zero sales.
