Vero violation questions.

This is a subject I see rather often, but seldom read much about unless I'm affected.  Of course I see a red banner policy notice at the top of my listings this morning for a vero violation.  I read some of the earlier posts on the board, but since I didn't get any email, I see no particular reason given to know how/what to fight.  The only options I have are appeal (afraid to click on for now) or end listing.  I'd rather not fight & will probably just end the listing, but do I now have a violation I need to do something about?

Yes.

 

Ultimately Fern needs to get eBay to send her a copy of the VeRO email that she didn't receive because of eBay's email bug that lasted from 12/26-today.

 

That email will tell her the reason for the takedown and give her the rights owner's contact info to dispute the takedown (assuming it was done in error). The reason for the takedown is important.

That depends. The reason for a VERO takedown can be a number of things.

 

It might be

  • a counterfeit item (ex. fake Legos),
  • an unauthorized item (ex. bootleg recording),
  • misuse of a brand name (ex. calling your homemade guitar a 'Stratocaster'),
  • claiming a used item has a manufacturer's warranty but that warranty is not actually transferable,
  • selling bundled software that is licensed rather than owned,
  • etc.

Just had contact with ebay & trust & safety said sorry the email wasn't sent & they will have it to me within 24 hrs to show reason for the violation & contact information.

I wanted to tell the guy at ebay that some messages and notifications are still being sent with no issues -- those annoying offers for items I only see for half a second out of the corner of my eye while browsing. 🙄

I still have the violation, but haven't yet received the promised email giving the reason or source for appeal.

Hi kyle@ebay - we discussed the other day impact of those missing emails from 12/26-12/31. Here's an example. @fern*wood was hit with a VeRO violation but did not get an email because eBay's system was down. She does not have an eBay message about it, either. So she can't even see the reason for the takedown or the email address of the rights owner to dispute the violation.

 

She contacted CS on 12/31 and was told they'd send a copy of the email and she'd have it within 24 hours, but she never received it.

 

Can you offer advice for Fern and other impacted sellers on how to get a copy of that email when contacting eBay CS did not work?

Hey @wastingtime101 thanks for checking in.  This is definitely a good example of why we're hoping the missed emails still go out.  

 

Hey  @fern*wood a couple of things.  First, from what you've described, it sounds like this may have just been a first warning, and if that's the case, I wouldn't stress about it.  Just don't relist unless you successfully appeal with the rights owner.  Which brings me to my second point.  I'd recommend contacting CS again to get those details.  Email or not, any agent can see the notes on your account and give you the info you need.

Fern - if you have a social account maybe contact CS that way, so you can refer back to the reason in writing for the takedown and the contact info for the dispute. Less room for error than a phone call and manually writing down the info they tell you, potentially getting the contact address wrong. 🙂

Thanks Kyle for this.  I'm not overly concerned and won't relist the item, but did want to see the reason given.  I don't know if it was just a warning, but it does show as a policy violation on my account. When I was on the phone with t & s, I asked if they could at least tell me the reason, but he said he couldn't see it.

I had to read Kyle's post a couple times, but I believe by "first warning" he meant "first violation" - in other words, only one violation isn't going to have much of an impact on your account, but repeated violations would. eBay probably sees the first few as "warnings" before more serious action like restrictions and/or suspension is taken.

 

I think I mentioned to you earlier - 1 violation won't have much of an impact, but if the reason for the violation was ridiculous (like they said you used their photos when you know you didn't), it's worth fighting it because you never know if another VeRO takedown will come along from another overzealous rights owner.

 

It's also why I said the reason for the takedown is important. Some you can fight and some are the brand trying to control sales of their product, abusing the system, and you can't fight them. And of course, some are legit.

 

Not sure if I told you I had a VeRO violation over the summer. The rights owner employed a third party to handle these things, and that third party used AI to comb the internet for violations, which mistook my photos for manufacturer stock photos. I guess my photos are that good. 😉 Just kidding.

 

So I reached out to the company and asked what specifically was wrong with my listing because photos were of products in my physical possession and I took the pics myself. They came back to confirm the violation was reported in error, then they filed an appeal with eBay which was granted in my favor. Gives me a little peace of mind in case another VeRO complaint is filed against me, I will be starting with zero strikes.

 

Edit to add: Although it does still show in my Resolution Hub, so not sure if it still counts against me? I did get an official appeal was approved email, and eBay un-hid my listing in search, and I recently sold out of the product.

 

It would be nice if there was a status column on the Resolution Hub kyle@ebay so we know whether or not the violation is counting against us.

Did you receive notice of a violation?

Usually the listing is taken down and you get the notice saying why and who to contact to contest it.

I fought one vero takedown abou a year ago.

It took me weeks of "arguing" but i finally won.

They even instructed ebay to reinstate the listing.

I forget if the listing still had the old sales history?

If you have the option to end the listing, it doesn't sound like you have a violation (yet). So there's nothing (yet) to appeal. 

 

When you get a violation, the listing is removed (without the option to take it down on your own) with a message describing what the alleged violation is and with an email address to which to send your appeal to the rights owner.


I thought I responded to this but I guess not. eBay actually changed this @albertabrightalberta . I don't know if it's universal (all sellers), if it's only for some sellers based on performance, or if it depends on the reason for the violation.

 

As Fern stated, her listing was still active, but hidden. That's the same thing that happened to me in July. You can see my screenshot a couple posts up ^^ that explains how eBay left it active and encouraged me to remove the flagged photo.

 

I did not revise it, just left it alone while I contacted the rights owner. The rights owner determined there was no violation and they flagged it in error, and they submitted the appeal to have it reversed. Because I did not end the listing and left it alone during this process, all the sales history was maintained when eBay restored (un-hid) the listing.

 

Edit to add: I'll make an educated guess and say the reason for the violation is a big factor. For example, if the rights owner says it's counterfeit eBay would probably remove the listing entirely. But if the rights owner says the seller used their images, eBay gives the seller an opportunity to remove those images without removing the listing.

I reached a different rep today and she stated my violation was because I'm not an authorized seller of this brand.  Still no emails for me.
