Hi
I have very old Walt Disney vhs videotapes.
I know that eBay has copyrights that apparently belong to BRAND NEW that should not be uploaded.
Am I allowed on eBay to upload very old video tapes with the Walt Disney brand?
Of course, the condition of the vhs I will not write new condition..only used or good condition..

No. Even though they're old, they are still under Disney's copyright. You may, however, re-sell the original VHS tapes.

If they are legit Disney tapes, shouldn't be a problem.
If they are ones you recorded, no.

I didn't understand you... you say on the one hand that even if they are old they are in Disney's rights, on the other hand I can resell original tapes? This contradicts what you wrote...original Disney in the original box from 30 years ago. It's tapes for collectors...can i sell or not in terms of ebay?

Yes you can sell them, no matter what age they are if they are genuine.
If they're "very old" I doubt they'd be "brand new" anyway.

When you said, "Upload," I thought you intended to sell copies. You can sell the original tapes.

It’s a fallacy that sellers can’t list new products if a company is on the Vero list. If an item is authentic you can list it. There are some companies who do not like their brands listed here and who will try to stop sellers from listing by saying the items aren’t authentic. But that’s not the norm. Or, eBay’s bots will take a listing down because they think it ‘may’ not be authentic. That seems to be happening more often but again, it isn’t the norm.

So if I were put a new DVD movie and put it as brand new then I would have a problem yes? ..as long as it's not in brand new then I guess everything should be fine....

The issue with all IP rights created products is proving they are genuine.
Proof they were purchased from an IP owner authorized source is your best defense,
Hard to find acceptable receipts for your old VHS purchases.
There are bootlegged VHS tapes, as well as counterfeits.

Used or new, you should be fine selling your tapes as long as they are the real thing and not a copy or bootleg version of the original movie by Disney.
You can search Ebay and get an idea of how others design their listings. Back when we changed the family over to DVDs, I sold off all our VHS tapes here on Ebay. I did my Disney tapes in a Lot, it fetched a nice price. We were very happy.

If it is a valid licensed product then you can re-sell it regardless of age or condition. Copyright law protects the copyright holder against others making COPIES of their protected item.
