VeRO issue

Christmas plates marked Georg Jensen Inc were removed due to VeRO .  I bought at estate sale and listed for $10.  I saw several similar plates listed. I was notified they were removed via the following:

Your listing was reported by Georg Jensen A/S for offering a counterfeit item.  eBay’s Verified Rights Owner (VeRO) program offers intellectual property owners a way to report listings that they believe infringe on their rights.

 

I attempted to send a question to Georg Jensen A/S. I couldn't find an email address.  I sent the following to their post page.

I purchased this item a few months ago. Are you charging that the item is fake or that you don't want me to sell Georg Jensen items? I am not sure the purpose of this notification.

  I can do without listing the plates.  However, I am not happy about this issue being on my record.

1.  Think of you situation as like getting a speeding ticket  while going over the max posted speed limit along with  everyone else but the officer pulled you over and cited you, you pay the fine & it stays on your record for sometime (depending on the state  you live in).

The contact information should have been in the takedown notice. If none was provided, contact E-Bay to complain and demand they provide contact info.

Make sure you fight the VeRO claim if they claimant can't offer you proof they are counterfeit. You can always file a counter claim, which will force them to either file a lawsuit against you within 10 days (would they over a $10 plate?), or remove the claim. Be sure they are real though, because they could be rich and PO'd and decide to take you to court over $10.

I am going through a struggle now where a manufacturer claimed the item was counterfeit and I proved that it wasn't. They asked E-Bay to remove the strike on my account. And even after all that, I am having to fight E-Bay to get the strike removed. It still hasn't been removed, and it has been over 4 days since the manufacturer contacted VeRO and asked to rescind their claim. Good luck if you decide to fight it. E-Bay will be against you the whole way, even after the claimant side with you!

I am no expert on plates, but there is a chance yours may have been fake. The makers marks on the back of yours (looked at the removed listing on pic click) are very heavy, and look blurry, not clear.

Also, I looked at Google for photos of the mark. I am seeing that most of them had marks in green ink (your looked black) and the mark was on the back center of the plate (where yours is to one side). Maybe the manufacturer made different runs and moved the mark around/changed the color, or maybe yours is fake?

Search this on Etsy "Vintage blue and white Danish Christmas collectible plate/ wall- hanging- 1974, Georg Jensen Inc." Same plate you were offering, but you can see the mark on the back is different than yours. Even "Made in Denmark" is all one line, not two like on yours.

So you may actually have offended by offering a fake for sale, which means this should actually be on your account. You will have to decide if you want to test your knowledge of Jensen plates against the manufacturer.

In my case, it was much easier to prove my item was authentic, because I could prove it was shipped by the manufacturer. And while investigating, they found out about mistakes their employees had been making (any discontinued item was being listed as counterfeit, because employees weren't aware there were discontinued items). A different situation than yours.
