VeRO **bleep** Cancelled Listings - Stated What was on insert: Velcro!

This takes the cake for me.... Sold off and on here since 1999 with 100% positive feedback. Listed some dog clothing - Velcro had 2 listings cancelled, the balance canned for 3 days... for writing what is plainly on the insert!

 

Line 3 of one package insert states: "Velcro closures for easy and secure fit". Line 3 of the other package insert states: "Velcro closures at chest and belly for a secure fit."

 

HOW am I infringing  on their copyright? The listings were:

274050062114 - Park Avenue Black Dog Jacket Coat Faux Leather Fur Fleece XL Velcro Clothes Warm
274050089301 - Denim Jacket Casual Canine Dog Clothing Clothes Coat Jeans Fur Velcro Warm Buff

 

And Ebay in their wisdom apparently won't even look at the listing for any verification. Photos shown of both inserts. What gives?

No, that wouldn't have worked. The problem is the word Velcro(r) needs to be used in accordance with the company's trademark guidelines. The alternative is to use a generic term. The company is protecting its trademark so that it doesn't end up in the public domain.

There are hundreds of tiny hooks and hundreds of tiny loops. Hook & loop fastener is the correct generic term.

 

Velcro is a name brand for hook & loop fastener much like Kleenex is a name brand for facial tissues or onesie is trademarked by Gerber to describe a one-piece bodysuit for babies or Microplane is a name brand for a rasp-style grater. Widely recognized terms, but trademarked and heavily enforced through eBay's VeRO program.

Actually, the term hook and loop is the proper generic term since that is what such types of fastener it is.  The system operates by one side having tiny loops which the other side, having hooks, grabs onto.

Actually there are tiny 'hooks' on one half, and tiny 'loops' on the other half. 

 

I make a product and use Velcro, buy Velcro brand industrial 1" wide 10' rolls, for our products to attach when they need to be easily removed by the customer. I was also 'nailed' by Velcro on a couple items by stating, get this.. 

not in the title, in the detailed written description, along with 1000 other words. 

 

So, we changed them all to say 'hook & loop', easier than fighting with Velcro, even though we buy $500 worth a year.

The item has Velcro ON it, but it's made by Casual Canine, NOT by Velcro. It shouldn't be that hard to understand.

I went rounds with ebay years ago re 'velcro'.  their contention is that 'velcro' is copywrited and trademarked.  the only out is to note 'hook and loop' in the listing instead of Velcro.  what I was told anyway 😕

Interesting thread to a novice seller such as myself. I have a drapery set that was custom made using Velcro pole pop fasteners. The actual brand of fastener IS Velcro. 

I will quickly add the suggested terminology, but to clarify.... If I purchase and USE Velcro, I can not use the name because VELCRO did not make the curtains?

I would be looking for an alternative to using Velcro® brand hook & loop fasteners if possible.

Well, I am going to turn it over to an attorney for a class action lawsuit. Not the first time those words were ever said. I own the product, I listed what was stated. Plainly on manufacturer insert. I didn't assume. I own this product, now it belongs to me to sell. VELCRO was on the tail of the title listing, not the front end.

No it shouldn’t Be hard to understand indeed.  If it is Velcro the seller should be able to say Velcro since it officially uses the Velcro brand.   No one is claiming Velcro made the product and that’s not the issue   If it were using the Velcro brand that would be allowed to be advertised as such.  Since as someone mentioned the wording isn’t written the correct way on the package if that brand is actually using Velcro or if Velcro isn’t approving of that brand use it because they do not have it written correctly

I have hit this brick wall myself, on occasion. Doing the research I found that others were doing the same thing as I was, simply showing the photos. It seems that ebay was allowing SOME sellers to do it, but not me! WHY? Copyrights and Trademarks are some very iffy areas. I all we are doing is selling items, new or sued, that have been sold before, maybe, where's the harm? As noted, look at other, similar listings and see how they are doing it. It may turn out that you just can't sell those items! I tried selling NEW, UNUSED contact lenses, but found out that just isn't allowed! I tried using different categories and verbiage, to no avail. To avoid being closed down completely, I just trashed them!

PS I tried selling them on other venues, but they didn't sell, but I didn't get the nasty notices, either.
