VERO unauthorized Item Policy

I listed some new, in the sealed package collagen from NATIVEPATH LLC. I bought these directly from Native path and still have the original mailing box from them. I have the original invoice and each container is sealed with a good use by date. As soon as I took the time and effort to list these I received a cancelled notice from e-bay stating a Vero policy saying these were counterfeit and unauthorized. I  was given a communication link with NATIVEPATH LLC which I used to tell them this information. I never received a reply. I was convicted of being a counterfeiter and my merchandise which is genuine and I own was denied a listing. Then reading the print from e-bay it states this can never be relisted. Why take time to state my case when I cannot rekist. This is unfair business practice on your part e-bay. I have turned you into the BBB and can do it again! I need a reply on this and soon as there is a use by date on my legitimate product.

There are some brands that don't want their items sold on Ebay and they'll have the listings removed.

What do you think the BBB can/will do?

Often when you get a VERO for counterfeit it can simply mean that you are not an authorized seller.  This is common with high profit margin items like beauty products and health supplements.  This is not an unfair business practice by Ebay but it is an unfair but common practice by corporate America.  Alas, resistance is futile.  Sell locally or perhaps another platform.

marketplaces where NativePath or NativePath, LLC is shown as the direct seller of the
products. NativePath does not and cannot guarantee authenticity or quality for products
purchased from unauthorized resellers."

eBay has to take an item down when a VERO owner asks them too. So your problem is with NativePath, not eBay.

Just adding on a bit.......

 

* Abuse depends on the reason given, if it's misuse of images, logos, text from their website then it's legal, if it's a claim of counterfeit it's not legal claim (presuming it is true that the product was purchased directly from Native Path).

 

There are ways to fight this but probably not worth the effort and could potentially be very costly.

When it's a VeRO removal, you have to appeal to the rights owner. 

 

Somewhere in the email message you received, there's contact information if you believe the listing was erroneously removed. 

 

Contact them, explain that you purchased the item directly from them and ask them if they need to see your proof of purchase. They may also require more pictures of your item. 

 

(You might also suggest to them that you since you have proof of the legitimacy of your item, you have the right to resell a legally obtained item as per First Sale Doctrine.)

 

They have 10 days to respond and in many cases, once authenticity is proven (assuming the item is authentic), they need to contact ebay to let them know they can reinstate the listing. 

 

Only after you get that reinstatement notification should you relist. Do NOT do it prior to getting the green light.

I went through a similar situation.

I got ignored by nativepath (in my case a different company).

I had to find a contact number to the company and speak to several different people until I spoke to a manager to tell them what was going on and that I was being ignored.

Apparently the VERO contact person answers to no one and can ignore you all day every day without consequence.

I eventually received a email from them saying I was good to go and they even contacted ebay to have ebay re-instate my listing.

P.S. Turning ebay into the BBB does absolutely nothing.

If i had loads of money I would sue the company for selling me counterfeit items. Since you have receipt of item, and their representative says its fake. They are doing false advertisement. 🤣 But I dont have the extra income nor time to entertain it.

In spite of your back story, a manufacturer may claim your item "may be inauthentic" if you are not authorized to sell it.

 

You might have bought some from the manufacturer or an authorized reseller but that does not mean you are selling the item you purchased that way.

 

Ebay has a vested interest in not allowing you to sell inauthentic items, since they may lose their immunity from being a party to a counterfeiting lawsuit if they ignore the rights owner's notification.

 

You engaged in a risky strategy and you are paying the price.

 

Although there are fewer sellers engaging in retail arb than there once were, those who have longevity know which brands not to sell.

It often means they don't recognize you as an authorized dealer. There are a number of products i won't buy to resell because they have given me grief and had my listings yanked.

The only way this would be a "risky strategy" is if the OP tried relisting the items, now that they were VERO'd. The risk of counterfeit in products obtained from the manufacturer is pretty low.

a brand not wanting their items resold on ebay is not  a valid reason for a vero claim
