Hello,
we are company stated in Europe Union. We have listed on German Ebay with the price including TAX. What happens if US customer buy product ? since if customer is outside EU it is not applicable for VAT.
How to handle that on eBay

I suspect this is one of the issues with VAT included pricing because there is no way to modify the amount. It is just one of the reasons I dislike tax included pricing as is common in the EU. Other countries such as Canada and Australia generally show value added taxes as a separate line item that can be easily eliminated when shipping outside the local area.

You may want to ask VAT questions on eBay's seller facebook page. You can get customer support assistance there. https://www.facebook.com/eBayForBusiness/

I am thinking for something like this:
Do a listing on .de ebay -> make prices with tax and ship only to Europe Union.
And than make a new listing (same product) to .com with the price off, but shipping to all except Europe Union.
Is any considerations with eBay about this ?

You might be better off asking your question on the German boards since the US is not a part of the European Union and has no VAT. How other EU member sellers deal with the issue might better be answered there.
